List of WK documents (September 26th- January 30th,2024 ) and texts linked to some Legislative procedures
Dear Council of the European Union,
Under art 15.2 TFEU, 16.8 TEU, dealing with Legislative Transparency of the Council meetings, as well as under art. 11, 12 and 15 of Regulation 1049/01 framing the Institution's duty to publish in the public domain legislative preparatory documents as defined by art. 289 of the TFEU, and debated at Council internal meetings, I am hereby requesting
1 - a LIST of the WK documents linked to EU legislative procedures (as defined by art 289 TFEU) and shared inside the Council Working Parties between 26th September 2023, and 30th January 2024th.
2 - the TEXTS of the WK and ST legislative preparatory documents linked to the following legislative procedures :
2022/0084 (COD) Information Security
2020/0279 (COD) AMMR (Ex Dublin)
2020/0277 (COD) (Crisis /Force majeure)
2016/0224(COD) (Asylum Procedure)
2020/0278(COD) (Asylum Screening Procedure)
May I take this occasion to stress that, according to art. 15.2 TFEU, 16.8 TEU dealing with legislative debates at Council internal meetings (also at working parties and Coreper level), and art. 2.4 and 12 of Regulation 1049/01 preparatory documents of legislative nature should be made directly accessible on the Council Register of documents (see case T-163/21), as well as, at interinstitutional level (Trilogues technical and political meetings - see Ruling T-540/15)
Indeed publishing in a timely manner legislative preparatory documents will save time and work not only of the requested Institution, avoid repetitive requests for the same documents by different EU citizens, and will also grant a non discriminatory access to all EU Citizens interested in following and participating to the EU legislative negotiations (as required by articles 9 and 10 of the TEU).
I am sorry to have to submit this specific formal request which will not be needed if the Council had made all these documents already on its Council Register of documents as, in my opinion it should do in compliance with its self standing constitutional obligation (foreseen by art. 15.2 of the TFEU and art. 16.8 TEU) of being transparent when acting as legislator.
It seems to me paradoxical that the scope of a constitutional obligation of legislative transparency should be triggered and depend from the aleatory condition that a Citizen’s requests, or not, some legislative preparatory documents.
