Trade/ the Commission working group "An Economy that Works for People"
with external stakeholders, in which the Retail Investments Strategy and
in particular a potential ban on inducements was discussed. Officials
excludes the Commissioner and his Cabinet.

3) Correspondence since 1st November 2022 between Commissioner
Dombrovskis, and/or his cabinet and/or officials from DG Trade/ the
Commission working group "An Economy that Works for People" with external
stakeholders regarding the Retail Investments Strategy and in particular a
potential ban on inducements.

Your applications concern a very large number of documents, which need to
be retrieved and assessed individually. Many of these documents originate
from third parties who need to be consulted and requested agreement for
disclosure. Such processing cannot be carried out within the normal time
limits set out in Article 7 of Regulation (EC) No 1049/2001. However,
Article 6(3) of Regulation (EC) No 1049/2001 also provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very large number of
documents. Therefore, in order to be able to respond to both of them in a
reasonable period of time, we would like to propose to narrow the scope of
your two requests.

We propose to narrow the scope of each request to cover only the documents
identified under the respective first point. This means the minutes
related to the identified meetings as listed in point number 1 of both
requests. In the absence of a reply to our proposal as formulated above
within five working days, we will unilaterally restrict the scope of your
applications as explained.

Regarding the rest of your requests, we invite you to lodge (a) new
request(s) limiting as much as possible their scope in order to help us
serve you in the most efficient way. We thank you in advance for your
cooperation.

Allow me one critical remark: I understand that you are working very hard to deal with the many information requests that must reach you. But I am shocked that it takes you nearly 5 months (!) and one reminder to ask me to narrow my requests while not releasing a single document. I don't think this is what is understood by a "fair solution" in the regulation.

Regarding the content of your proposal:
* I would like to narrow the scope of my requests to points 1) and 2) of each request and would like to ask you to consider the Commission's Code of Good Administrative Behaviour when dealing with point 2) of the requests (for which you do not have to consult third parties).
* I would also be happy if you could produce the documents on a rolling basis in order to be able to respond in a reasonable period of time and serve me in the most efficient way.
* I will send a new request covering part 3) of my original requests, as you suggest, and will try to narrow it further.
