Dear Permanent Representation of Portugal to the EU,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting:

- All documents - including but not limited to minutes, (hand-written) notes, audio recordings, verbatim reports, operational conclusions, lines to take, e-mails, and presentations - related to the meetings members of the Permanent Representation of Portugal to the EU have held with interest representatives on the Digital Services Act and the Digital Markets Act (including previous iterations of the proposals such as New Competition Tool and Markets Investigation Tool) since 01 October 2020 until today;

- All correspondence (i.e. any emails, correspondence, telephone call notes, and/or text messages including WhatsApp exchanges) between members of the Permanent Representation of Portugal to the EU with interest representatives on the Digital Services Act and the Digital Markets Act (including previous iterations of the proposals such as New Competition Tool and Markets Investigation Tool) since 01 October 2020 until today.

Considering the current situation and challenges it presents for post delivery, I would appreciate receiving all the replies electronically via the asktheeu.org website.

Allow us to call your attention to the fact that Regulation 1049/2001 does
not apply to Permanent Representations or Diplomatic Missions, as they are
framed by specific legislation, both of national and international nature,
such as the Vienna Convention on Diplomatic Relations (1961). If you are a
Belgian citizen you may wish to consult the following official webpage:

The said EU legislation [Regulation (EC) No 1049/2001 of the European
Parliament and of the Council, of 30 May 2001, regarding public access to
European Parliament, Council and Commission documents] applies to the EU
institutions only and access to documents drawn up or received by those
institutions can be directly requested by citizens.

 

Concerning meetings with interest representatives, the Inter-Institutional
Agreement (IIA) on a mandatory Transparency Register is of binding nature
for the signatory institutions (the very same bound by the Regulation).
The Portuguese Permanent Representative and Deputy Permanent
Representative have been applying the IIA, on a voluntary basis, as both
incoming rotating Presidency of the EU Council (01.07.2020-31.12.2020) and
current rotating Presidency of the EU Council (01.01.2021-30.06.2021),
meaning that they consult the Transparency Register prior to accepting a
meeting with an interest representative. If the requested meeting does
take place, the date and the name(s) of the interlocutor(s) are published
on our webpage.
