Lobby meetings/correspondence on Plastics and Circular Economy

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the period between 01 July 2017 and 30 June 2019:
- a list of all lobby meetings held by any rapporteur and/or shadow rapporteurs on the committees responsible for legislation 2018/0172(COD) - Reduction of the impact of certain plastic products on the environment - including MEPs Frederique Ries, Karl-Heinz Florenz, Massimo Paolucci, Mark Demesmaeker, Lynn Boylan, Margrete Auken, Piernicola Pedicini, Barbara Kappel and Bronis Ropé.
The list should include: date, individuals attending and organisational affiliation, as well as the issues discussed;

- all minutes and other reports of these meetings;

- all correspondence, including attachments (i.e. any emails, mail correspondence or telephone call notes) between any rapporteur and/or shadow rapporteur on the committees responsible for legislation 2018/0172(COD) (as outlined above) and any lobby group and/or industry representative;
- all documents prepared for the purpose of the meetings and/or exchanged during the course of the meetings.

Further to your application seeking public access to documents concerning
all lobby meetings, for the period between 01 July 2017 and 30 June 201,
held by any rapporteur and/or shadow rapporteurs on the committees
responsible for legislation 2018/0172(COD) - Reduction of the impact of
certain plastic products on the environment, Parliament informs you that
the only document that has been identified is the list of entities or
persons from whom the rapporteur has received input and that was provided
on a voluntary basis by the rapporteur appointed on this file ( Ms
Frédérique Ries MEP). This list is included as an annex at the end of the

In addition, please be informed that the scope of Regulation (EC) No
1049/2001, as defined in its Article 2(3), extends only to documents held
by an institution, that is to say, documents drawn up or received by it

The documents that might have been generated by the organisation of the
meetings to which you make reference in your application are not
Parliament documents within the meaning of Article 2(3) of Regulation (EC)
No 1049/2001 since they are not documents hold by Parliament. More in
detail, please note that there is indeed an organic separation between the
public mandatories (MEPs) and the European Parliament itself. According to
Rule 122(2) of Parliament's Rules of Procedure "[...] documents drawn up
by individual Members or political groups are Parliament documents for the
purposes of access to documents only if they are tabled in accordance with

Under the light of these provisions, as far as Parliament is concerned,
please note that only documents held by the institution (Parliament's
documents) can be subject to request for public access. Therefore,
documents generated by the individual MEPs or the political groups, using
their professional Parliament mailbox, or other means, for the
organisation of the meetings to which you refer in your application,
cannot be considered as Parliament documents for the purpose of applying
Regulation (EC) No 1049/2001 since they remain in the political sphere of
the individual MEPs and political groups that generate them. Parliament
has thus not been able to identify any documents concerning the
organisation of the meetings to which you refer between the MEPs concerned
and third parties.

 

On this basis, Parliament considers your application as handled and the
file closed. Should you have any new requests for specific Parliament
documents, please do not hesitate to come back to us.
