Many thanks for your reply to my request for documents last 30 May 2016, and thanks for granting me access to 22 of the documents.

You wrote that for the rest of the documents, 'third-party consultations' were still ongoing and that I will receive a separate reply with those documents when consultations are done.

Since this batch of 18 documents relates to more than 10 different member states, this may mean that if just one member state is significantly slower in concluding the third-party consultations, all the other documents are held up.

It being 16 June now, I wonder if any third-party consultations have been concluded since your reply to my request on 30 May. If so, could you already send me those documents?

related documents. This is a follow-up to the replies sent on 30 May 2016
and 21 June 2016. Our apologies for the delay.

 

As foreseen by Article 297 of the Treaty on the Functioning of the
European Union (TFEU), decisions which specify to whom they are addressed,
shall be notified to those to whom they are addressed and shall take
effect upon such notification. Replies triggering the possibility for
administrative or judicial redress are therefore transmitted via
registered mail with acknowledgement of receipt.

 

In order to obtain legal certainty as regards the date of receipt of the
reply by the applicant under Regulation 1049/2001,  the following
categories of replies are normally sent via registered mail:

 

- Negative reply

- Partially negative reply

- Devoid of purpose reply (=no documents found)

- Reply containing documents from which personal data has been redacted

 

The letter would normally be sent to you via registered mail. However, in
your e-mail of 7 July 2016 you requested to receive only a digital copy of
all future replies.

 

Thus we consider that the fifteen-day period for making a confirmatory
request starts to run from tomorrow (the day after the reply e-mail is
sent). Please don't hesitate to let us know if you disagree with this and
would like to receive the letter via registered mail after all.
