Dear Research and Innovation,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- list of rejected Horizon 2020 proposals.

For each proposal I would like to know ALL the following information:
- Proposal title
- Abstract
- Consortium composition

In addition, if possible:

- Call and topic
- Funding requested
- Allocation of the funding requested by partner.

Background information:

Which data I would like to see open?

The EU's Publication Office publishes datasets containing information on all research projects funded by the European Union under the subsequent framework programmes for research and innovation, currently Horizon 2020. These are extracted from the CORDIS information system, used by the Commission to administer the programme: receive applications, validate the eligibility of applicants and so on.

The aim of our request is to encourage the EU Commission to complete those datasets with information on the non-funded proposals.

What benefit would access to that information bring?

Three reasons support such a request. The first argument is one of market-making. One of the goals of EU-funded research is to foster collaboration ties between universities and the private sector (with a particular attention to SMEs). Knowing the full history of submissions would help newcomers into the framework programme to choose its partners wisely. If I am an SME looking to participate in a research programme, I would prefer to partner up with university A, who produces relatively few proposals but curates them well, and so has a high success rate. University B produces very many proposals; while it might have the same number of successes as University A, its success rate is lower. Since I am only going to present the one proposal, which is useful for my business, I would like to know the success rates of potential partners. This is not possible without access to the data of unsuccessful proposals.

The second argument is one of nurturing research. Having this information would allow the research community to study how its probability of success depends on several variables. Again, to know this it is necessary to have information on the non-funded proposals.

The third argument is one of general transparency. These data, like all administrative data, should be public and available by default at least insofar as they do not infringe IP rights and personal data . It's the Commission itself who should champion full transparency and pro-active publication.

I am filing the following confirmatory application with regards to my access to documents request 'Publication of non-funded projects'.

Thank you for granting us partial disclosure of the information requested.
However, we have also asked to disclose inter alia the "consortium composition" for each H2020 rejected proposals. As we are not asking for the full text of the proposal, which would inherently be covered by Article 4(2) first indent exception, but merely the information about who is behind that grant submission.

We argue that - assuming this disclosure could undermine the protection of commercial interests of the legal persons involved (quod non) - there is an overriding public interest in disclosure of such a piece of information.

Disclosure would enable consortium members to be publicly known so as to increase synergies needed to put together high-quality proposals. The overall research environment requires transparency and accountability. The argument that the public image would be tarnished by disclosure of an unsuccessful proposals is not only speculative but also contradicts the collaborative spirit the governs the research community and the H2020 overall objectives.

I refer to your email of 9 July 2019, registered on 10 July 2019, through
which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents ('Regulation (EC) No
1049/2001').

 

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements we need to carry out
a full analysis of your request in order to take a final decision and,
therefore, we are not in a position to reply to your confirmatory request
within the prescribed time limit expiring 31 July 2019.

 

Consequently, we have to extend the deadline for handling it by another 15
working days in accordance with Article 8(2) of Regulation (EC) No
1049/2001. The new deadline expires on 22 August 2019.
