Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I would like to request information on the one case for job authorisation (article 16, Staff Regulations) that we understand the Commission has rejected since January 2008. This information should include all applications made in this case, decisions and correspondence, as well as an explanation as to why this particular case provoked a concern for the Commission.

We refer to your request for access to documents dated 24/5/2012, wherein
you requested

decisions and correspondence, as well as an explanation as to why this
particular case provoked a concern for the Commission."

As you are aware, for reasons of protection of personal data, the
Commission does not keep a central register of all applications under
Article 16 of the Staff Regulations and the decisions pertaining thereto.
On the contrary, such individual decisions are deposited in the personal
file of the staff concerned. The Commission services are therefore not in
a position to give information on a non-identified person.

In more general terms, please let me recall that the right to work is a
fundamental right, even with constitutional rank in some member states.
The Commission is therefore obliged to seek a proportionate solution for
cases where there is evidence of a possible conflict of interest. It is
only when restrictions are under no circumstances sufficient to avoid such
conflict of interest that the Commission will prohibit the exercise of a
post service activity.

Since it is not possible therefore to identify concrete documents on the
basis of the description given in your request, we are not in a position
to respond to your request, which does not match the criteria of
Regulation 1049/2001.

Dear Madam,

We refer to your e-mail dated 23/05/2012 in which you make a request for
access to documents, registered under the above mentioned reference
number. Your application is currently being handled. However, we will not
be in a position to complete the handling of your application within the
time limit of 15 working days, which expires on 14/06/2012.

An extended time limit is needed as your application concerns documents
held by different Services which must be consulted. Therefore, we have to
extend the time limit with 15 working days in accordance with Article 7(3)
of Regulation (EC) No 1049/2001 regarding public access to documents. The
new time limit expires on 05/07/2012.

We apologize for this delay and for any inconvenience this may cause.
