PS: I have noticed that European institutions sometimes send both a digital and a paper version by registered mail of FOI responses. Please only send paper versions of your communication if you do not intend to send a digital copy. Maritime Safety Agency (EMSA) on the 8th of May 2017, please find the

After carefully assessing your application, and in line with the
provisions of Regulation (EC) No.1049/2001 of the European Parliament and
of the Council regarding public access to documents, EMSA can refer you to
the Draft general budget of the European Commission for the financial year
2017, document which contains all the essential information with regards
the name, location and type of the building we are occupying, and
furthermore – details of the annual rent, including further specificities

Note that, in line with Article 7(2) of Regulation (EC) No.1049/2001 of
the European Parliament and of the Council regarding public access to

Dear Madam, Sir,
Many thanks for your reply and your referral to the Draft general budget of the European Commission for the financial year 2017.
However, that document does not contain a specific element of information I am interested in: the clause in the rental contract(s) that governs termination of the contract(s).
Can you please send the contract(s) or at least the page(s) of the contract that deals with how and when the contract(s) can be terminated?

Dear Mr. Teffer,
With regards your follow-up request related to the initial application for access to documents dated 8th of May 2017, request received by the European Maritime Safety Agency (EMSA) on the 1st of June 2017, please find attached a scan copy of the Lease Agreement EMSA has concluded with APL Lisbon for the lease of the building(s) which EMSA is currently using as headquarters in Lisbon Portugal.
Note that certain parts of the document have been already erased as follows:
- taking into consideration latest terrorist attacks throughout Europe and in line with the provisions of Article 4(1)a. of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents, none of the Annexes to the Lease Agreement shall be disclosed as these contain plans and blueprints of the rented buildings;
- in line with the provisions of Article 4(1)b. of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents, all references to personal data that is not public information already have been erased;
- in line with the provisions of Article 4(2) and 4(4) of Regulation (EC) No.1049/2001 of the European Parliament and of the Council regarding public access to documents, more detailed renting prices per sqm. have not been disclosed as these are the subject of direct negotiations with a third party and disclosure of these could undermine the protection of the commercial interests of this legal person.
Information on available remedies can be found in Article 8(1) of Regulation (EC) No.1049/2001.
