Dear PAD,

In your own web page (https://frontex.europa.eu/operations/ret...) it is stated that "all return operations must be monitored in accordance with EU law and a forced-return monitor must deliver a report to the agency and to all the Member States involved in the given operation". I am asking for that report in the cases I specified in my original request.

Yours sincerely,

Álvaro Merino

Dear Mr Merino,

With reference to your confirmatory application CMS-2019-00011-0959 regarding your initial application CMS-2019-00010-1025, please be informed that confirmatory applications are possible only for cases prescribed in Article 7(2) and (4) of Regulation (EC) No 1049/2001.

Your application CMS-2019-00010-1025 was registered on 31 October 2019. Consequently, the 15 working days expired on the end of the day of 25 November 2015. Frontex replied to your application CMS-2019-00010-1025 on 25 November 2019. Consequently, Frontex did not fail to reply in the sense of Article 7(4) of Regulation (EC) No 1049/2001.

Your confirmatory application CMS-2019-00011-0959 alleging a failure to reply in the sense of Article 7(4) of Regulation (EC) No 1049/2001 is thus inadmissible.
