Requests made by the EU to private companies for personal data
Dear European Data Protection Supervisor,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1) The amount of requests made by any bodies in the European Union for personal information from private companies such as Facebook, Twitter, Google, etc from January 1st 2012 to present, or if such statistics are only available on a year by year basis, from January 1st 2012-December 31st 2012.
2) If such requests were made, a breakdown of which companies the requests were made to and from which EU bodies.

As you know, we are currently assessing your access to documents request
registered on 26 November under ref. 2013-1315.
You requested "The amount of requests made by any bodies in the European
Union for personal information from private companies such as Facebook,
Twitter, Google, etc. from January 1st 2012 to present, or if such

In this respect, we would like to clarify that, on the basis of its
founding act, Regulation (EC) No 45/2001, the EDPS supervises the
application of the data protection rules set out in that Regulation by EU
institutions and bodies, including the European Commission, the European
Parliament and the Council of Ministers. The EDPS is not responsible for
receiving or treating requests from EU bodies on personal data held by
companies, nor for making statistics on these matters. The EDPS is not
competent for assessing compliance with data protection regulations of
Member States, governments or companies.
The European Commission is responsible for the transposition and
application by Member States of the general data protection Directive
95/46/EC. In turn, enforcement of national data protection laws
(transposing Directive 95/46/EC) is the competence of independent national
Data Protection Authorities.

In its consultative role, the EDPS advises the EU institutions and bodies
(but not the Member States, DPAs or companies) on data protection issues
in a range of policy areas. We analyse proposals for new EU legislation
and EU soft law instruments that affect personal data protection in the
EU.

Finally, the EDPS cooperates with national authorities in order to promote
consistency in the protection of personal data throughout the EU. The
central forum for cooperation is the Article 29 Working Party, where the
national data protection authorities meet to exchange views on current
issues, to discuss a common interpretation of data protection legislation
, to give expert advice and to promote the uniform application of the Data
Protection Directive.
