RSB annual report 2021
Dear Secretariat General of the European Commission,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am wondering why the Corporate Sustainability Due Diligence file does not appear in the list of files looked at by the RSB in its 2021 annual report: https://ec.europa.eu/info/files/regulato...
Furthermore, when will the RSB's 2022 annual report be published?
Finally, how many impact assessements have received either a negative first or second opinion from the RSB in 2022 and which legislative proposals did they relate to?

Dear Ms.Cann,
We are writing concerning your request for access to Commission documents
registered on 24/10/2022 under case number 2022/6015.
Your request is formulated as a request for information rather than as a
request for documents and cannot be handled under [1]Regulation (EC) No
1049/2001 which applies only to existing documents. Therefore, we have
closed this case.
Nevertheless, under the Code of Good Administrative Behaviour, we are
happy to provide you with a reply to your specific questions:
1. why the Corporate Sustainability Due Diligence file does not appear in
the list of files looked at by the RSB in its 2021 annual report
Please note that the 2021 annual report of the Regulatory Scrutiny Board
does actually include the corporate sustainability due diligence file, in
its annex listing impact assessments.
1. when will the RSB's 2022 annual report be published
The next annual report of the Regulatory Scrutiny Board will be published
in the second quarter of 2022.
1. how many impact assessments have received either a negative first or
second opinion from the RSB in 2022 and which legislative proposals
did they relate to.
Impact assessments are published with the corresponding legislative
proposals. On the files adopted in 2022 until October, six impact
assessments have received a first negative opinions. They concern the
following files:
- Proposal for a Regulation on fluorinated greenhouse gases
(recast)
- Short-term rentals initiative for a stronger tourism ecosystem
- Revision of the Urban Wastewater Treatment Directive
- Initiative on instant payments in the EU
- European Media Freedom Act
- Single Market Emergency Instrument
As you already know, the corporate sustainable due diligence file has also
been adopted in 2022.
You find all the proposals, with the corresponding impact assessments and
RSB opinions in the Commission register of documents at the following
