Silicon Valley Mission Report and BOLO list debates

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- The full "mission report" of the EDPD mission to San Francisco, Silicon Valley and Napa Valley (US) from November 6-12, 2018 and all meeting minutes and other documents related to the mission

- Board meeting minutes, reports and all other e-mails and documents, including the entry to the Common Market Information System, relating to Facebook's "be on the lookout" internal information system, as referred to the EDPB by the Hamburg DPA.

I am filing the following confirmatory application with regards to my access to documents request 'Silicon Valley Mission Report and BOLO list debates'.

Under the Regulation 1049/2001 regarding public access to European Parliament, Council and Commission documents, Article 4 (3), I was denied access to 8 documents falling under the scope of my request. The sections in questions states that 'if disclosure of the document would seriously undermine the institution's decision-making process, unless there is an overriding public interest in disclosure.'

It is very hard for me to tell whether the disclosure of the documents in question would actually 'seriously undermine the institution's decision-making process', as I am not privy to them. However, I would like to argue that, after one year of the full application of the General Data Protections Regulation, there is an incessant public debate about data protection and how to deal with the behaviour of corporations such as Google and Facebook. The documents in question are likely to shed light on the discussion process of European group of regulators and their dealings with these and other corporations that so far has largely escaped the eye of the public.

I would argue that, in the light of the ongoing debate about privacy, competition and related debates around disinformation, hybrid threats, etc. and new EU laws such as the ePrivacy Regulation and the Digital Services Act being considered, there clearly is a need for the public to better understand the debate within regulating bodies and the challenges faced in making regulatory decisions. I therefore argue there is an overriding public interest in disclosing the documents in full.
