Dear DG Grow,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

the European Commission's analysis of, decisions on and responses to and actions taken regarding the three notifications of requirements under the Services Directive (Article 15(7) and 39(5)) that are listed here on the Commission's website:

The notifications are dated 22/11/2019, 18/03/2020 and 02/06/2020.

In other words: documents that show how the Commission analysed the notified measures and their compatibility with the Services Directive, the decisions the Commission has made on these three notifications, as well as the communication with the Spanish government and/or local authorities and other action taken on the notifications.

The online listing of notifications is part of new steps taken by the Commission (in the absence of the Notification Procedure Directive being finalised and agreed) "to ensure that Member States comply with the existing notification obligation under the Services Directive in order to identify and eliminate new potential regulatory barriers." There is, unfortunately, no further information in the public domain on how exactly this will work, which means public scrutiny and informed debate is difficult. There is therefore a clear public interest in the release of the requested documents, as an example that throws light on and clarifies the Commission's new approach.

correspondence.  In that case, the Commission will send all future
electronic correspondence addressed to you only to that private address,
and it will use only that private address to reply to your request. You
should still remain responsible to inform the private third-party website
about this change of how you wish to communicate with, and receive a reply
from, the Commission.

above mentioned reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires today (20/10/2020).


An extended time limit is needed as part of the documents requested
