Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) a list of meetings of DG Trade officials and/or representatives (including the Commissioner and the Cabinet) and stakeholders, including trade unions, civil society groups, as well as representatives of individual companies, industry associations, law firms, public consultancies and think tanks in which the Japan-EU Free Trade Agreement (JEFTA) was discussed (between January 2012 and December 2013);

2) minutes and other reports of these meetings;

3) all correspondence (including emails) between DG Trade officials and/or representatives (including the Commissioner and the Cabinet) and stakeholders, including trade unions, civil society groups, as well as representatives of individual companies, industry associations, law firms, public consultancies as well as think tanks regarding the Japan-EU Free Trade Agreement (JEFTA) (between January 2012 and December 2013).

I would appreciate if you could take the Code of Good Administrational Behaviour into account when considering section 1 of this request.

We refer to your request for access to documents, registered on 27/04/2017
under the above mentioned reference number.

 

The initial examination of your request leads to the conclusion that your
request concerns a large number of documents which is also why it took us
until today to get back to you. We apologise for having taken longer than
expected and hope for your understanding.

 

We would like to inform you that so far we have identified 132 documents
that would fall under the scope of your request. Please find attached a
list of these documents; for each of them the list provides the type of
document, the date and a description. This list may be amended in the
event that we find additional documents relevant to your request.

 

Regulation 1049/2001 provides for a possibility to confer with applicants
in order to find a fair solution when an application relates to a very
long document or concerns a very large number of documents. Article 6(3)
provides that in the event of an application relating to a very long
document or to a very large number of documents, the institution concerned
may confer with the applicant informally, with a view to finding a fair
solution.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your request and your specific interest in the documents
requested and whether you could narrow down the scope of your request
(i.e. the subject matter(s) and/or timeframe covered), so as to reduce it
to a more manageable amount of documents.

 

To give you an idea of the overall timeline, we would expect to be able to
process a batch of up to 30 documents within 30 working days. This
includes:

-              assessment of the content of the documents in light of the
exceptions of Article 4 of Regulation 1049/2001;

-              third-party consultations under Article 4(4) of Regulation
1049/2001;

-              final assessment of the documents in light of the comments
received;

-              drafting of the reply;

-              redaction of those parts of the documents to which one or
several exceptions apply(ies);

-              internal approval of the draft decision on your request;

-              preparation of the reply and the documents for dispatch.

 

It follows that, according to our first estimates, a maximum of 30
documents could possibly be dealt with within 30 working days.

 

We would kindly ask you for a swift reply to our invitation to propose a
fair solution. In the absence of a reply within five working days, we will
unilaterally restrict the scope of your application to those parts that
can be dealt with within the extended deadline of 30 working days.

I have been waiting for the handling of my application registered with reference number GestDem 2017/2503 for more than three months by now and also reduced the scope of my request to 32 instead of 132 documents.

I would ask you to send me the requested documents in a row from now on within the next 5 working days until the 8th August. In case you will not complete the handling of my application within this time limit (until the 8th August), I reserve the right to got the Ombudsman on this request.

thanks for letting me know that the handling of my request registered with reference number GestDem 2017/2503 is even further delayed than expected. This is very unfortunate. It is also unfortunate that you have not been sending the requested documents in a row since August 1st 2017.

I hope very much that the handling of my application will be completed by the end of the week, i.e. by Friday 11th August.
