Dear Mrs Kenna,

 

We refer to your request for access to documents under Regulation (EC) No
1049/2001 concerning the submissions made by the European Commission and
by Ireland in Case C-109/17 Bankia SA v. Juan Carlos Marí Merino.

 

Your request is currently being handled by the Legal Service. However, we
have not been in a position to complete the handling of your application
within the time limit of 15 working days, which expires today, 22/10/2018.

 

An extended time limit is needed as your request concerns a document of
which the Commission is not the author and, according to Article 4(4) of
that Regulation the Commission has to consult the third party  on the
disclosure of the document. This consultation procedure adds an additional
administrative step to the handling of your access request.  

 

Moreover, following the judgment of the Court in Case C-213/15P Breyer,
the Commission has received a large number of access requests concerning a
very large total number of documents where third parties need to be
consulted.

 

Under these circumstances, we have to ask for an extended deadline in
conformity with Article 7(3) of that Regulation. The new deadline will
expire on 14/11/2018. We will inform you in due time in case the treatment
of your request could not be finalised before the expiration of the second
deadline.

 

Furthermore, we would kindly remind you our email below concerning the
language versions of the requested documents. As already indicated, the
language of the proceedings is Spanish. Therefore, the submission by the
Government of Spain is only available in Spanish and a translation into
French made by the services of the Court of Justice. Could you please
specify which linguistic version would interest you?

meant Case C-109/17 Bankia SA v Juan Carlos Marí Merino, rather than
C-109/71.

Furthermore, please note that the case-language is Spanish, hence the only
submission available in English is that of the Republic of Ireland.

Please specify whether you would like to receive the European Commission's
submission in Spanish or rather a French translation thereof.

All submissions will be assessed in accordance with Regulation 1049/2001,
after having consulted their authors.
