Thank you for your request of 20 June 2013, requesting access to documents under Regulation (EC) No 1049/2001 regarding public access to documents. According to Article 118(1) of Regulation (EC) No 1907/2006 (the so-called “REACH Regulation”), Regulation (EC) No 1049/2001 applies to documents held by the European Chemicals Agency (ECHA).

Your requested access to :
1) all communications between ECHA and the secretariat/members of the Sustainable Apparel Coalition;
2) Internal reports, minutes and communications on sustainable apparel supply chains, the Sustainable Apparel Coalition, and the Higg Index (since 2009);
3) Any documents or communications relating to Nike's 'Considered Index'.

After an extensive search carried out by all the competent services, we would like to inform you that no documents falling within the scope of parts 2 and 3 of your request were found.

In addition, as far as part 1 of your request is concerned, we would like to clarify that there is correspondence of ECHA with some of the entities listed as members of the Sustainable Apparel Coalition in the website http://www.apparelcoalition.org/ (visited on 20 June 2013). However this correspondence is of regulatory nature and relates only to the specific obligations of these entities under the REACH Regulation and Regulation (EC) No 1272/2008 (the so-called "CLP Regulation") and not the activities of these entities in their capacity of members of the said Coalition. While the REACH Regulation requires the registration of substances manufactured or imported into the EU in quantities exceeding 1 ton per year, the CLP Regulation ensures that the hazards presented by chemicals are clearly communicated to workers and consumers in the European Union through classification and labelling of chemicals. As a result, to our understanding this type of correspondence has not been found as falling within the scope of your request.
