Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Could I be provided a detailed table, by day, of how long it has taken the EU bodies to provide a final response to FOI requests made within the last 3 years?

A table detailing how many have been answered the following day, 2 days later, 3 days later and so forth would be ideal.

Dear Mr Augusto,

 

On 4 May 2021, via the platform [6]asktheeu, you asked the European
Ombudsman’s Office to grant you public access to “a detailed table, by
day, of how long it has taken the EU bodies to provide a final response to
FOI requests made within the last 3 years”. You request was registered on
the following day under the reference Ares(2021)3002769. We have dealt
with your request in accordance with Regulation 1049/2001[7][1] regarding
public access to documents and the Ombudsman’s Decision on the handling of
requests for public access to documents[8][2].

 

We have carefully considered your request and I am sorry to inform you
that we do not possess any documents falling within the scope of your
request. As specified in Article 2(3) of Regulation 1049/2001, the right
of access as defined in that regulation applies only to existing documents
in the possession of the body concerned.

 

Please note that the Ombudsman examines complaints when an EU institution
or body refused to grant access (also partially) or if it failed to take a
decision within the applicable deadlines. Thus, the Ombudsman sees only a
limited number of replies provided by the institutions or bodies to
requests for public access. We record such information only to the extent
necessary for the assessment of the complaint in question. Therefore, we
are not in the position to provide the comprehensive and complete overview
that you would like to obtain. You may consider submitting your request
directly to the EU bodies concerned, which may be in a better position to
address the matter.

 

In order to be as helpful as possible, please note that the Ombudsman has
recently published a [9]report on the review of how we are dealing with
public access complaints (the ‘Fast-Track procedure’). While the report
does not cover the specific issue you have raised, it contains other
statistical data that you may find useful.

 

Finally, please note that we can provide information on the time taken to
reply to public access requests submitted to the Ombudsman’s Office.
However, please note that we do not record information on which day a
reply has been provided, but only when an extension of the deadline to
reply was necessary based on Article 7(3) of Regulation 1049/2001.  

 

Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to

decision. Our Secretary-General will then handle the review request.
