Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Please note that this document has been mentioned in Bureau agenda PE-9/BUR/OJ/2022-13, and therefore should be in principle made public, according to a majority of MEPs.
(On 28 April 2016 the European Parliament adopted a resolution, in which it called on the Parliament "to make available the agendas and feedback notes of the meetings of committee coordinators, the Bureau and the Conference of Presidents, as well as, in principle, all documents referred to in these agendas ... by publishing them on the parliament's website". The text received the support from an 86 percent majority (523 yes votes, 37 no votes, and 46 abstentions).
On 14 September 2017, the European Parliament adopted another resolution (368 yes votes, 161 no votes, and 60 abstentions). In the resolution, the parliament recalled “its calls on the Commission and the Council in its resolution of 28 April 2016 on public access to documents for the years 2014-2015 , in which it: … called for agendas and feedback notes of the meetings of Parliament’s Committee Coordinators, Bureau and Conference of Presidents to be made available, and, in principle, for all documents referred to in those agendas to be made available too, by publishing them on Parliament’s website”.)

As you are well aware, Regulation 1049/2001 only allows for an extension of the time limit to reply in "exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents". Moreover, such extension is conditional on the applicant being given "detailed reasons".
The only reason given is that the delay was necessary "due to the nature of the matter at issue". That is not detailed. It is outright vague. Please provide a more detailed reason why my request, which concerns just one letter which is not "a very long document" or "a very large number of documents", should be considered exceptional.
As for the postal address, I have said in the past that in the 21st Century I do not expect nor require a printed version of information already delivered to me by e-mail. This continued practice is wasteful.

On 25 November 2022, the European Parliament informed me it would extend the time limit. The same day I replied to this message, asking for a more detailed reason why my request, which concerns just one letter which is not "a very long document" or "a very large number of documents", should be considered exceptional.
I have not yet received an answer to that request.

I am filing the following confirmatory application with regards to my access to documents request on Letter from Mr WIELAND, Vice-President, Chair of the ad-hoc Working Group, about the Outcome of the deliberations of the ad-hoc Working Group on General Expenditure Allowance (GEA).
I refer to the Parliament's reply of 13 December 2022, reference number 2022-1380 (which, against my explicit request, has been sent by postal mail rather than e-mail).
The parliament has denied access to the letter from Mr Wieland, using the same arguments as in 2018, when it denied access to another letter from Mr Wieland about the general expenditure allowance, and the 2018 Proposal from the ad hoc Working Group on the revision of the list of expenses which may be defrayed from the General Expenditure Allowance.
Once again, the parliament is arguing that because these are preparatory documents they should not be made public, because if they are made public it could in future lead to self-censorship.
However, since my 2018 request, there has been an investigation by the European Ombudsman. On 16 September 2019 she found that the public interest overrides the need to protect the Parliament’s decision-making process (1). It made a recommendation that Parliament should grant public access to the relevant letter and proposal (which Parliament declined to follow).
I believe that in the present case, the public interest too would override the need to protect the Parliament’s decision-making process.
The context is the same as described in the Ombudsman recommendation in 2019: "this is a situation in which MEPs, as members of the Bureau, decide on the coverage of expenses from the GEA. At the same time, those MEPs receive repayment of those expenses under the GEA. Given this situation, in which MEPs act as decision-makers whilst also being the receivers of the expenses, the Ombudsman finds that there is an overriding public interest in scrutiny of the Bureau’s decision-making process. Such a public interest also exists in ensuring that the rules governing the use of the GEA are assessed objectively and set sensibly."
The Ombudsman said "that the public should have an insight into how the administrative decision was made in this case and which options were proposed and discussed", adding "that public scrutiny of Parliament’s administrative decision in this matter is of importance for public trust in the responsible use of public funds by their elected representatives".
Additionally, the Ombudsman said that "public disclosure of the requested documents is unlikely to discourage future working groups from discussing the use of the GEA freely and openly", considering "that the public would recognise that different options were considered carefully and that the Working Group fulfilled its mandate diligently".
I believe all the above statements apply to the current case as well, and I therefore request that the Parliament reviews its position taken on the matter.
As a final point, I URGE the Parliament to send its replies to me by e-mail, and not by letter. The claim by the Parliament that "notification by registered letter with an acknowledgement of receipt is required in order to ensure legal certainty as regards your receipt of Parliament's decision, pursuant to the third subparagraph of Article 297(2) of the Treaty on the Functioning of the European Union (OJ C 326, 26.10.2012, p. 47)" is nonsense.
The mentioned subparagraph states that decisions "shall be notified to those to whom they are addressed and shall take effect upon such notification", but it does not say that they should be notified with a physical letter. Many EU institutions have notified me of decisions regarding access to documents requests by e-mail, without resorting to registered letters.
In fact, the European Parliament itself has made several decisions regarding my access to documents requests without seeing the need to send a registered letter. For example: document applications 2022-1486, 2022-1125 and 2022-0858 have all been handled digitally. I have not received registered letters notifying me of the Parliament's decision in those cases. If the Parliament can notify me of its decision in those cases via e-mail, it could do the same in all cases.
The European Parliament has acknowledged (2) it has a "responsibility for making a positive contribution to sustainable development as a long-term goal" and has committed to reducing paper consumption. It should refrain from sending registered letters, which are an unnecessary use of paper and contribute to transport pollution.

Dear Mr Teffer,
In response to your messages inviting Parliament to convey its decision
relating to the confirmatory application with reference 2022-1380 by
email, Parliament reiterates that legal certainty as to the date of
receipt of the decision by the applicant must be ensured (see the third
subparagraph of Article 297(2) of the Treaty on the Functioning of the
European Union (OJ C 326, 26.10.2012, p. 47)). Legal certainty with regard
to the receipt is particularly essential for decisions for which the
applicant can require administrative or legal redress, in order to
calculate the legal deadlines connected to those remedies (see for
instance Articles 7(2) and 8 of Regulation (EC) 1049/2001 and Article 263
of the Treaty on the Functioning of the European Union).
Moreover, as recognised by the [1]EDPS decision in case C2014-0458,
requiring a postal address enables the institutions to counter abusive
recourse to access to documents applications under Regulation (EC)
1049/2001, through the introduction of requests under a false or invented
identity.
In light of the above, Parliament offers two alternative solutions: the
decision can either be conveyed through a registered letter with an
acknowledgment of receipt; or it can be collected in person by the
applicant.
