Dear Mr Schindler,

I am writing in reply to your request for public access to documents to
the European Ombudsman to information and documents concerning Palantir
Technologies.

Your request was registered under the reference number Ares(2020)4025511.
We have dealt with your request in accordance with Regulation 1049/2001
and the Ombudsman’s Decision on the handling of requests for public access
to documents.

Following a broad internal consultation, we have identified the following
two documents as falling within the scope of your request:

COMPLAINT_201902054_20191111_115631

NOTE_202001208_20200729_142124

We have decided to grant you partial access to the first document. We have
redacted the documents with a view to protecting personal data in
accordance with Article 4(1)(b) of Regulation 1049/2001 and with
Regulation 2018/1725.

We regret to inform you that, at this point in time, we cannot grant you
access to the second document, which relates to an ongoing inquiry of the
Ombudsman [6]SI/4/2020. This is because disclosing the document at this
point in time would undermine the protection of the investigation and
would also prejudice the Ombudsman’s decision-making process aimed at
taking a decision on the case. Disclosure of the document it thus
prevented by Article 4(2) third indent and Article 4(3) first subparagraph
of Regulation 1049/2001.

According to Article 4(2) third indent, access to a document shall be
refused if its disclosure would undermine the purpose of inspections,
investigations and audit.

According to Article 4(3) first subparagraph, access to a document, drawn
up by an institution for internal use or received by an institution, which
relates to a matter where the decision has not been taken by the
institution, shall be refused if disclosure of the document would
seriously undermine the institution's decision-making process.

The exceptions laid down in Article 4(2) third indent and Article 4(3)
first subparagraph of Regulation 1049/2001 apply unless there is an
overriding public interest in disclosure of the document. While we note
that the issue has been the subject of media coverage, there is nothing to
suggest that disclosure of the specific document would contribute to the
public debate and could outweigh the legitimate interests, which are
protected by the above exceptions.

In accordance with Article 4(6) of Regulation 1049/2001, we have
considered whether partial access to the documents could be granted.
However, we have concluded that no meaningful partial access is possible.

Finally, you could consider making a new access request once the Ombudsman
has closed her inquiry into case [7]SI/4/2020. We would then reassess the
application of the above-mentioned exceptions. You may also check our
website concerning further developments in the case.

Please also note that the European Ombudsman’s Office never purchased
products, directly or through another company, or requested an offer from
Palantir Technologies.

Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to
[8][European Ombudsman request email] within 15 working days of having received this
decision. A review request would then be handled by our Secretary-General.

You are welcome to contact me through our office e-mail or by telephone
with any questions or requests for clarifications you may have.

Kind regards,

Tereza Mandjukova
