Reply to MEP in ‘t Veld
The rapporteur presented the draft letter on this topic, which clarifies that the EDPB directly cannot
enforce, but that this falls onto the national data protection authorities. Further, the letter highlights
that some national authorities have already contacted their national governments.
It was also clarified that this kind of agreement is not subject to prior authorisation of the SA or the
EDPB and that those agreements, if they were adopted prior to the GDPR becoming applicable, stay
valid until amended.
It was discussed that in some member states the SAs are not empowered to act on these agreements
if they are not directly involved in the agreement. Additionally, some SAs confirmed that they have
not received any complaints on this issue. However, some SAs have received individual complaints.
The draft letter was approved in its current form, with a possible addition of a reference to national
complaints. The rapporteur wil prepare the info note and the document wil be submitted to the July
Plenary meeting.
