Adoption of draft Agenda (IMCO(2006))
A draft Order of Business has been circulated.
The Chair may wish to postpone the Coordinators meeting (intended to
agree the programme of Delegations and Hearings for 2007) to the next
Committee meeting.
If there are no objections, or further suggested additions or changes, the
draft Agenda can be deemed adopted.
NOTE:
It is understood that there may be a request for the
postponement of the
vote on the Second Reading of the Services Directive, which would be
admissible under Rule 170, paragraph 4 ("
Before or during a vote a
political group or at least thirty-seven Members may move that the vote
be adjourned. Such a motion shall be put to the vote immediately"),
which applies to Committees by analogy (Rule 186). The rule carries an
interpretation which specifies that such a vote to adjourn "
shall specify
the part-session on the agenda of which the debate is to be included",
which, by analogy, would mean that the date of the meeting on which the
adjourned vote would take place should be specified.

Announcements by the Chair
The Chair may wish to indicate that, in the event of the Committee being
concerned by the
Hearings for the Commissioners designate from
Romania and Bulgaria, it will be necessary to convene a meeting on
Monday 6 November to agree a specific Questionnaire.
It is also recommended (by the Conference of Committee Chairmen) to
meet on
Thursday 26 October in the afternoon, but, given that Members'
travel plans would be difficult to change and the draft Questions from
Political Groups could be submitted by
written procedure.

Adjournment of the vote
Rule 170(4) "before or during a vote, a political group or at least
thirty-seven Members may move that the vote be adjourned. Such a
motion shall be put to the vote immediately" (pursuant to Rule 186,
this rule also applies to committee. A political group or a Member
may therefore move such a motion).
Final vote:
(1) Before the final vote on the Adoption of the Draft
recommendation for second reading, the Chair could give the floor
to the Rapporteur
(2) Pursuant to Rule 61(2), the Rapporteur may move a motion to
reject Council's common position at any stage (before the vote on
the amendments, during the vote or before the final vote). If such a
motion is tabled by the Rapporteur, Members voting in favour
would support the rejection of the common position.
(3) In view of the outcome of the vote in committee, the Chair
would declare the common position to be deemed to be approved,
amended or rejected (if the motion to reject is adopted), pursuant to
Rule 152, 61, 62 and 67.
(4) Pursuant to Rule 59, the committee shall submit a
recommendation for second reading proposing the approval,
amendment or rejection of the common position. The
object of the
final vote is therefore the draft recommendation for second
reading. Thus, Members voting in favour of the adoption of the
draft recommendation would support the outcome of the vote in
committee and would approve the submission of the draft
recommendation to Plenary. Those Members voting against the
draft recommendation would not be satisfied with the outcome of
the vote in committee and would ask the Rapporteur to look at the
matter again before submitting it to Plenary.
