In Ireland we do not have any legislation specifically governing hemp products, just the novel food 
Regulation. As yet there is no specified tolerance level for THC and therefore any level would be in 
breach of the misuse of drugs Act 1977 as amended. 
 
In terms of what is novel and what is not novel with regard to hemp and hemp products, in Ireland we 
have been advising for many years based on a previous version of the NF Catalogue. See a screenshot of 
the entry for Cannabis sativa from the 2009 version of the catalogue below which the Commission 
circulated to Member States on CD. 
You can see that it states “Regulation (EC) No 258/97 is not applicable to most foods and food 
ingredients from this plant
”. While I could foresee a food or ingredient going from novel to not novel, it 
is difficult to explain to the industry how a food that was not considered novel becomes novel. 
The updated catalogue in terms of cannabinoids is satisfactory from our view, with the long-held 
premise with regard to extracts being acknowledged. However, I would be uneasy about trying to 
amend the plant entry without justification as it would mean that at least we in Ireland have been giving 
out inaccurate advice for some years based on the NF Catalogue. This would possibly present a 
credibility and reputational risk for all of us involved in novel food regulation.

In the last time in Romania there is an invasion of food supplements containing cannabis, CBD, various 
extracts from cannabis, some of them probably illegally placed on the market or some companies who 
intend put on the market such products! 
 
There have been discussions many times in WG, including the latest meetings which, unfortunately, I 
could not attend. In this context, can you tell me if you have specific legislation regarding this field? As I 
know, some countries have such legislation, especially Italy, Belgium, Austria, Ireland, Denmark. 
 
We are in discussions with many authorities whether it would be necessary to initiate a legislative 
proposal on CBD products, food supplements in particular!!!
