Travel expenses of ECA President

Dear European Court of Auditors,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am hereby requesting access to the travel expenses of ECA's President, for the period 1 January 2016 to 31 December 2016 inclusive.

I am looking for documents that contain, for each of the trips, the following information:
- Place of origin and destination, and the amount spent on travel or transportation;
- Exact dates and duration of the trip;
- Amount spent on accommodation;
- Amount spent on subsistence;
- Other information, such as possible miscellaneous costs.

If the travel was by air taxi and a team of people were travelling, please also provide documents with details on the other travellers (at a minimum, names and job titles).

With respect to personal information contained in any documents that you might have, I note that the only information being sought here is the name and surname of ECA's President, something which is already in the public domain. This request does not seek access to any other personal information such as bank account details. Nor am I requesting data such as the office addresses, signatures or telephone numbers of ECA staff members.

Thank you for contacting the European Court of Auditors (ECA).
 
With reference to your request for access to documents submitted on 16th
January 2018, please find enclosed all relevant documents containing the
travel expenses of the President of the ECA related to the period 1.1.2016
– 31.12.2016. The information contained in the “Travel expenses” document
responds to the points mentioned in your request and is summarised in the
“Missions” table.
 
Your request for access to documents has been processed in accordance with
Articles 6 and 9 of Decision No 12-2005 of the Court of Auditors regarding
public access to Court documents (as amended by [1]Court Decision No
14-2009) and not with Regulation 1049/2001^[1], which is not applicable to
our institution.
 
Please be aware of the fact that travel expenses refer to two different
names due to President Heiner-Klaus Lehne taking over from President Vítor
Manuel Caldeira during the course of 2016 (more precisely, on 1st October
2016).
 
Moreover, we would like to point out that the documents to which you
request access contain personal data (e.g. office number, telephone
number) of the person performing the mission and names and personal data
(e.g. office number, telephone number) of the ECA staff in charge  the
reimbursement. According to Article 4.1 (b) of Decision No 12-2005 of the
Court of Auditors (as amended), the ECA shall refuse access to a document
where disclosure would undermine the protection of privacy and integrity
of the individual, in particular in accordance with Community legislation
regarding the protection of personal data. Pursuant to Article 8 (b) of
Regulation 45/2001^[2] (the relevant legislation as regards protection of
personal data) personal data shall only be transferred to recipients if
the recipient establishes the necessity of having the data transferred and
if there is no reason to assume that the data subject's legitimate
interests might be prejudiced. In your request you clearly state that you
do not seek access to personal data other than the ECA President’s name
and surname. Therefore, in order to comply with Article 4.1 (b) of
Decision No 12-2005 of the Court of Auditors (as amended) and Article 8
(b) of Regulation 45/2001, these data have been blanked out.
