General information and adoption of the Agenda
The agenda was adopted.
The Minutes of the FOP meeting of 20 March 2018 were adopted.
The Minutes of the FOP meeting of 14 May 2018 were adopted, after taking into account the
comments of the FR DPA.
Opinion on DPIA lists (Art. 64(1)(a) GDPR) - implication for the EDPB
enforcement strategy
The Chair and the Secretariat of the Board provided the FOP members with a state of play on the
current situation:
It was suggested to have the draft opinions prepared by a dedicated team of rapporteurs from the
Technology subgroup in liaison with the Secretariat. Several DPAs already had expressed their
interest to participate in the drafting team at the Technology subgroup meeting. In this regard it was
agreed that the Chair Coordination Team will send out a call for rapporteurs, followed by their
confirmation at the next plenary in order to start the work on the draft opinions asap.

ICANN: Future engagement strategy
On 10 May 2018, ICANN addressed a letter to the WP29, raising a number of questions which had
already been the topic of discussion during the meeting between ICANN and WP29 members on 23
April 2018. A draft answer to this letter was agreed by the Technology subgroup and will be
submitted for adoption at the EDPB Plenary of 4-5 July 2018.
Members of the FOP were invited to share their views on what strategy to apply for the further
interaction with ICANN.
Judgment in Wirtschaftsakademie (C-201/16): implications for the
EDPB enforcement strategy
The FOP members suggested to assess the possible implications of the Judgement at the level of
each subgroup:

Coordinators’ meeting: Future of the Subgroups - summary of the
discussions
The Chair together with the Secretariat of the Board provided the FOP members with a state of play
regarding the discussions that had taken place at the Coordinators’ meeting on 15 June 2018.
The discussions at the FOP revolved around the rebranding of the FOP and the eGovernment
subgroup. Further the procedure for handling article 65 cases was discussed.
The FOP members agreed that the Chair will take the raised discussion points into
account and give it some further thinking in order to provide the EDPB with name suggestions as the
next step.
The FOP members agreed that for the time being, the Enforcement SG and the Cooperation SG will
have to work back to back instead of being merged.
The question of handling “article 65 GDPR” decisions was raised. Due to the short deadline to issue
such a decision, there is a need to determine a workflow for the effective and swift handling of those
cases. FOP Members also underlined the importance to issue a workflow for article 66 GDPR as well.
Several DPAs supported the idea, that it should be possible to discuss cases in the article 65 and 66
procedure in an ad hoc expert subgroup, if deemed to be necessary, e.g. in a complex case, in order
to support the decision making by the EDPB

Privacy Shield
The Chair provided the FOP members with an update regarding the participation of the
US Ombudsman at the next plenary meeting on the 5th of July. Internal report on the

LIBE Committee: draft motion for a resolution regarding suspension of the Privacy
Shield
The Chair informed the FOP members about the draft motion. This motion will be discussed by EP
plenary on 4 July 2018.
Request of the US Mission to the EU
Miscellaneous
The Chair informed about the sent out letter regarding her recent/up-coming speaking
engagements (e.g. Bloomberg Tv, Wallstreet Journal…).
The Chair asked EDPB members to provide her with numbers of complaints to be dealt with
at each DPA. Especially laying down the comparison of the number of cases before 25 May
2018 and afterwards. This is important to support the credibility of the EDPB as well as it is
important that DPAs are aware of the issues brought to each other.
