BTLE Subgroup meeting

1. Agenda
Draft agenda is adopted.
2. Minutes of last meeting
Minutes of 26 April subgroup meeting are adopted.
3. BTLE after 25 May 2018 (
- Secretariat explained its new role under the GDPR and Police Directive, and what
organisational changes are involved. Some members made requests regarding AGM
and rooms arrangements.
- Future of BTLE: discussions took place at the last coordinator subgroup meeting about
several subjects (
i.e. name of the subgroup, opportunity to restructure the work of
BTLE with the work of other subgroups). No immediate change to the BTLE in this
respect should be expected in the short term.
4. EDPB guidelines
Coordinator asked the subgroup to reflect on the need to issue such guidelines on data breach
considering the work already done on this subject under the GDPR.
Coordinator asked whether members could volunteer as rapporteur on these topics at the
next meeting and agreed to list and prioritize future activities of the group.

5. Privacy Shield (
On the basis of the discussions, a press statement might be prepared for approval by the 4-
5th July plenary.
The organisation of the European Union Centralised Body using resources of the EDPB (such
as email address) will be discussed at the next BTLE meeting.
6. EU proposal on e-evidence
The BTLE discussed the outline document on the proposal for a regulation and a directive
regarding the “e-evidence package”. The group supported the structure proposed by the
rapporteurs.
Comments raised by members will be taken into account for the further drafting of the
document and will be discussed, if possible during the summer, at the latest at the next BTLE
meeting.
7. Article 48 GDPR/US cloud act
8. Future of supervision models for EU large IT systems in the JHA area
COM explained the state of play of the discussion around the updated Regulation 45/2001
and the general model envisaged in Art. 62 to address the supervision of large-scale IT
systems. COM will come back to the group with more information on the entry into force of
the different texts with an impact on the supervision models.
BTLE discussed the chart of replies to the questionnaire prepared by the rapporteurs. The
group will further discuss in September the future “working methods”, as referred to in Art.
62 (3) of the updated Regulation 45/2001, for the coordinated supervision in the framework

of the EDPB. In meantime, the rapporteurs and the Secretariat will meet at the beginning of
July, potentially on 9 July, to have further discussions on this and to draft a document.
9. To-do/Next steps
The next meeting will take place on 6 September 2018.
