Strategic Advisory Expert Subgroup meeting

Welcome
The Chair welcomed the participants. The Chair emphasised the fact that the aim of the
meeting is to discuss technical consequences in case of a no-deal Brexit. The aim is not to
have political talks on Brexit.
Adoption of the agenda and the minutes of the last meeting
(09.01.2019)
The draft agenda was adopted.
The minutes were adopted.
Information document on Brexit - Discussion
Following the decision taken by the members during the last plenary meeting on the 22-23
January 2019, the
prepared an information document to help companies in case of
a no-deal Brexit. The
presented the structure and the content of the document and
the members of the Strategic Advisory expert subgroup (SAESG) were invited to share
comments.
The
explained that comments from the International Transfer expert subgroup
(ITSESG) have been received and are already integrated in the text. The
highlighted
the fact that an annex part on BCRs has been added to the information note by the ITSESG.
Members of the SAESG discussed the text paragraph per paragraph. Changes were directly
incorporated in the text in track changes.

Members of the SAESG agreed to reformulate the introduction and to change the titles.
Content wise, members of the SAESG agreed to simplify and clarify the text to meet the
demands of the intended target group of small and medium-sized enterprises.
Regarding
the annex part on BCRs, members of the SAESG agreed on the content (with an alternative
wording for the third paragraph) and were of the opinion that it should be included in a
separate document. Members of the SAESG agreed that this annex and the information note
should be published separately on the EDPB website.
Question from Politico on Brexit - discussion
Information on BCRs and OSS cases currently dealt with by the ICO
The ICO explained the content of their documents on the BCRs and the OSS cases where they
are currently acting as lead supervisory authority. The ICO promised to submit draft decisions
for 15-20 unnamed cases in its role as the lead supervisory authority to other supervisory
authorities concerned.
Miscellaneous
General strike in Belgium on the 13 February 2019
A general strike has been confirmed in Belgium on 13 February 2019. In order to avoid
difficulties for members of the Board, the Chair decided to hold only a one-day meeting for
the next plenary. The plenary of February will be held only on 12 February 2019.

Table of content of the EDPB Annual report
The
presented the proposed structure of the report, and requested for input and
contributions from members.
The time frame for the report is mid-April 2019.
A member of the SAESG asked a change of wording regarding the two references to the IMI
tool. Both changes have been directly introduced in the text of the table of content and
members of the SAESG agreed with the revised version.

- EDPB Sec to update the information note on Brexit.
- EDPB Sec to prepare an info note explaining the information note on Brexit that will be discussed at
the next Plenary meeting on 12 February 2019.
- EDPB Sec to write an info note explaining the documents on the BCRs and the OSS cases for which
the UK SA is currently acting as lead supervisory authority.
- EDPB SEC to update the table of content for the EDPB annual report.
- EDPB Sec to prepare an info note regarding the Annex on BCRs that will be presented as a separate
document at the next Plenary meeting on 12 February 2019.
