Dear Sir,
We refer to your e-mail of 22 April 2020 in which you make a request for access to
documents, registered on 22 April 2020 under the above-mentioned reference number.
We regret to inform you that the Directorate-General for Internal Market, Industry,
Entrepreneurship and SMEs (DG GROW) does not hold any documents that would
correspond to the description given in your application, concerning correspondence, minutes
and other reports of meetings between the European Commission’s DG GROW and
representatives of the European Union of Private Hospitals (UEHP) between December
2014 and today.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.
Given that no such documents, corresponding to the description given in your
application, are held by DG GROW, we are not in a position to fulfil your request.
We take this chance, however, to note that since the 1st of January 2020, all files concerning
medical devices previously held by DG GROW have been transferred to the Directorate-
General for Health and Food Safety (DG SANTE), in compliance with the new
competences of the two Directorates-General.
