Penalties
(England) Regulations 2019
48.—(1) A person guilty of an offence under regulation 38(1), 39,

summary conviction to a fine.
(2) A person guilty of an offence under regulation 44 is liable—
(a) on summary conviction, to imprisonment for a term not
exceeding three months, to a fine
or to both;
(b) on conviction on indictment to imprisonment for a term not
exceeding two years, to a fine or to both.

51 (1) A person guilty of an offence under regulation 38(1), 39, 41,

5 on the standard scale.
(2) A person guilty of an offence under regulation 44 is liable-
(a) on conviction on indictment to imprisonment for a term not
exceeding two years, to a fine or to both;
(b) on summary conviction, to imprisonment for a term not
exceeding three months, to a fine not exceeding the statutory
maximum or to both.

(Scotland) Regulations 2019
47.—(1) A person guilty of an offence under regulation 37(1), 38,

40(1), 41(1) or 42(1) is liable on summary conviction to a fine not
exceeding level 5 on the standard scale.

(2) A person guilty of an offence under regulation 44 is liable—
(a)on summary conviction, to imprisonment for a term not
exceeding 3 months or a fine not exceeding the statutory maximum
(or both),
(b)on conviction on indictment, to imprisonment for a term not
exceeding 2 years or a fine (or both).
