Dear Mr Hoedeman,
I refer to your e-mail of 6 November 2020, registered on the same day, in which you
submitted a confirmatory application in accordance with Article 7(4) of Regulation (EC)
No 1049/2001 regarding public access to European Parliament, Council and Commission
documents1 (hereafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of 15
September 2020 in which you requested access to documents related to, I quote,
‘all reports (and other notes) from meetings of the Vaccines Procurement Steering
Committee and the Joint Negotiation Team (JNT) with representatives of pharmaceutical
companies about Advance Purchase Agreements (APAs) and the purchase of potential
vaccines against COVID-19.
- all correspondence (including emails and their attachments) between the Vaccines
Procurement Steering Committee and the Joint Negotiation Team (JNT) and
representatives of pharmaceutical companies (including Sanofi-GSK, Johnson &
Johnson, CureVac, AstraZeneca, Moderna and others) about Advance Purchase
Agreements (APAs) and the purchase of potential vaccines against COVID-19.

- a list of all the above-mentioned documents (including dates, names of
participants/senders/recipients and their affiliation, subject of meeting/correspondence).’
The initial request was assigned to the Directorate-General for Health and Food Safety
and subsequently to the Health Emergency Preparedness and Response Authority. As
you did not receive an initial reply within the statutory time limits, you submitted a
confirmatory application on 6 November 2020.
The initial reply was handled in several batches. The Secretariat-General was informed
that the final batch with documents falling within the scope of your request has been sent
to you on 31 May 2022.
Against this background, the Secretariat-General will close your confirmatory application
related to the lack of initial reply.
You remain entitled to submit a new confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial
reply.
