Ref. Your complaint 360/2021/TE to the European Ombudsman
Dear Mr Teffer,
In a letter of 18 June 2021, the European Ombudsman informed the Council of the outcome of her
inquiry into your complaint against the decision of the Council to refuse full access to internal
documents concerning the trilogue negotiations on the proposal for a Regulation on the type
approval of motor vehicle emissions (our ref. confirmatory application 01/c/01/21).
The Ombudsman did not find an instance of maladministration in the handling of your confirmatory
application and agreed with the Council’s reasoning in its additional observations of 19 April 2021
as regards the inquiry into your complaint.
The Ombudsman made a proposal for a solution consisting of giving you access to three additional
four-column documents not identified at the stage of the confirmatory application, but used during
the trilogues negotiations with the European Parliament and identified in the course of the inquiry.
I'm pleased to inform you that the Commit ee of the Permanent Representatives decided yesterday
on behalf of the Council to accept the proposal of the Ombudsman.
You wil find enclosed three 4-column documents shared with the European Parliament during the
first three trilogue meetings on the legislative proposal in question.
