Applications for documents in 2012, refusal of access relying on article 4.1.A 4th indent - ‘financial, monetary and economic’ policy

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I refer to the list of applications pursuant to Regulation No 1049/2001 of 2011 and 2012 that the Secretariat-General released in GestDem 2013/3752, http://www.asktheeu.org/en/request/641/r....

In the applications listed below, the Commission services refused total access either in the initial reply or in the final reply relying on, inter alia, on article 4.1.A “Protection of public interest - fourth indent - Financial, monetary or economic policy”. The excerpts below are literally a copy-paste of a few columns of the released PDF document under GestDem 2013/3752, serving as the means to identify the applications.

The present application concerns the release of the following documents that the Commission services drew up in the framework of the administrative procedure of Regulation No 1049/2001 as regards the aforementioned six past applications (‘the past applications’).

I. Any documents drawn up as preliminary correspondence that the Commission services addressed to the applicants prior to the dispatch of the formal initial reply. Such correspondence might concern an invitation to an applicant for more information allowing the precise identification of the documents, or an extension of the initial 15-day period, or releasing one or more documents - but not all. partially or fully - falling under the scope of the application. This request also expressly concerns (a) emails drafted by the Commission services, and (b) notes to the file following telephone conversations or teleconferences or meetings with the applicants or their lawyers, as the case may be.

II. The document constituting the initial reply (six in total), excluding the released document(s).

III. I. Any documents drawn up as preliminary correspondence that the Commission services addressed to the applicants prior to the dispatch of the confirmatory reply. Such correspondence might concern an extension of the initial 15-day period. This request also expressly concerns (a) emails drafted by the Commission services and sent to the applicants, and (b) notes to the file, or minutes, following telephone conversations, or teleconferences, or meetings with the applicants or their lawyers, as the case may be.

IV. The document constituting the confirmatory reply (five in total), excluding the released document(s).

The following points are made with respect of the application.

A. The application does not request the transfer of personal data, and therefore the parts of the documents disclosing personal data (i.e. the applicants, affiliations and contact details) are to be redacted from the released documents.

B. Request (III) and (IV) do not concern GestDem 2012- 1502 because no confirmatory application was lodged.

C. Having redacted the personal data of the applicants, the Commission services are to fully release the documents. This is so because, obviously, no other exception of article 4 of Regulation No 1049/2001 is applicable to the requested documents.

D. According to the second subparagraph of article 10 of Commission Decision 2001/937 (OJ 29/12/2001 L 345 page 98) the Secretariat-General holds copies of the initial replies. Only for the purposes of the request under (I) the Secretariat-General will have to consult the Directorate-General.

E. For the avoidance of any doubt, it is reiterated that the application does not request the release of the documents that the Commission services provided the past applicants with, and were the subject of the past applications.
