Dear European Court of Auditors,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Report from the Commission to the Council – Assessment of third countries’ level of cooperation on readmission for the years 2020 and 2021. I additionally request the results of the questionnaire which served as the basis of this report, as well as any annexes to the report.

Thank you for contacting the European Court of Auditors (ECA).

 

From your message of 19 November 2022, we understand that you are asking
to receive the “Report from the Commission to the Council – Assessment of
third countries’ level of cooperation on readmission for the years 2020
and 2021”. Moreover, you are also asking to receive the “results of the
questionnaire which served as the basis of this report, as well as any
annexes to the report”.

 

Your request has been treated according to the rules on public access to
ECA documents, which are set out in [1]Decision No 12/2005 of the Court of
Auditors regarding public access to Court documents (as amended by ECA
Decision No 14/2009, consolidated version published in OJ C 67/1 of
20.03.2009) (altogether, "the Court's Decision"). Please note that
Regulation 1049/2001 regarding public access to European Parliament,
Council and Commission documents is not applicable to our institution.

 

We would like to underline that, from the perspective of the Court's
Decision, the above-mentioned documents are third-party documents (of
which the ECA is no the author) that the ECA is not allowed to disclose,
even if it were in possession of such documents,in accordance with Article
4.5 of the ECA’s Decision on access to documents. As regards third-party
documents, the ECA shall confirm receipt of the application and supply the
name of the person, institution or body to whom the application must be
addressed.
