Giovanni Mastrobuoni

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I have downloaded the information on JO TRITON that has been successfully requested by Pauline Maillet, November 27, 2015 and Giacomo Battiston, September 03, 2017.

Compared to these two requests, which contained the following variables:

Operation/Year
Detection date
Search and rescue involved
Incidents
Total number of irregular migrants
Death cases
Irregular migrants in SAR cases
Type of detected by
Latitude detection
Longitude detection
Latitude interception
Longitude interception
Detection by Frontex financed/deployed asset
Type of intercepted by
Interception by Frontex financed/deployed asset
Operational area
Transport type
Reference to op.area
Frontex financed/deployed asset during an incident

covering the following period, Nov 2014-Sep 2017, I would like to request a few additions, both in terms of years covered and new variables.

In terms of years and operation covered I would like to request any data updated for 2018, including data pre-Nov 2014 covering Joint Operation Poseidon, Poseidon Rapid Intervention, Operation Hermes, and, if available, data on SAR operations pre-TRITON, for example those covered by the Mare Nostrum operation of the Italian Navy and Air force. I would need data going back until Jan 1, 2009.

In terms of variables, on top the variables listed above, I would like to request information on the weather conditions recorded by Frontex at the time of rescue, the specific organization (e.g. MSF, MOAS) the rescue vessel belongs to and the name of the rescue(intercepting) vessel, as well as the name of the vessel that detected the migrants.

Yours faithfully,

Giovanni Mastrobuoni

Dear European Border and Coast Guard Agency,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Boat Interception Data between 2009 and 2018'.

Thank you for replying to my data request. I managed to have a look at the data.

I fully understand that Frontex may want to hide the exact location of recent rescue operations (2018).

Given that the exact location of the rescue operations (as well as a wealth of additional information, see the list of variables below) was already available in the data you provided following Battiston's request (Giacomo Battiston, September 03, 2017) I do not see why such information pre-2018 should not be disclosed.

Therefore, I would like to reiterate the following request:

Individual level data on each single rescue operation as in Battiston's data:

Operation/Year
Detection date
Search and rescue involved
Incidents
Total number of irregular migrants
Death cases
Irregular migrants in SAR cases
Type of detected by
Latitude detection
Longitude detection
Latitude interception
Longitude interception
Detection by Frontex financed/deployed asset
Type of intercepted by
Interception by Frontex financed/deployed asset
Operational area
Transport type
Reference to op.area
Frontex financed/deployed asset during an incident

extending in terms of time coverage from 2012 to 2017.

A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/boat...

Yours faithfully,

Giovanni Mastrobuoni

Please be informed that since you have received the reply to your initial application on 31 August 2018, the legal deadline for submitting a confirmatory application has now passed and thus, your confirmatory application is inadmissible.
