Dear Competition,

The Tees Valley Report published on the UK government website on 23 January 2024 includes a finding that subsidy control requirements were breached.

No meaningful action has been taken by the government. Indeed the leader of the public authority involved has appeared on TV to say he will not change the deal which forms the breach.

The failure to address this serious issue surely means UK is in breach of its competition law commitments within the EU–UK Trade and Cooperation Agreement.

So far, there has been no public statement on this issue by the European Commission’s competition directorate, which is interpreted by some to mean the EU is toothless on such issues and the UK can ignore its commitments to the EU.

Therefore:

1. provide all documents created and received by the European Commission since 1 January 2024 in regards to breaches of state aid / subsidy control law in Tees Valley, England.

Whilst I note arguments may be made to the effect that this information need not be shared, there is a strong public interest argument given the importance of the Level Playing Field, should the UK not be held to important provisions such as 373.1 and 371 of EU-UK TCA.

2. Please provide any documents created since 1 January 2023 which relate to the EU using its rights under 374 of the TCA.
