All letters, e-mails, papers, and presentations from the French government arguing in favour of a European carbon border tax, or other carbon pricing measures, as well as any minutes, records or e-mails summarising the French position about such measures, since 1 September 2017.

We refer to your request dated 26/04/2019 in which you make a request for access to documents, registered on 26/04/2019 under the above mentioned reference number.

Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 21/05/2019.

An extended time limit for more in-depth investigation is needed in order to complete our assessment on the possibility for the public disclosure of the document requested.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 14/06/2019.

We apologize for this delay and for any inconvenience this may cause.

I would like to inform you that your confirmatory application is currently
being handled. Unfortunately, due to ongoing consultations, we are not in
a position to reply to your confirmatory request within the prescribed
time limit expiring on 20 May 2019. Consequently, we have to extend this
period by another 15 working days in accordance with Article 8(2) of
Regulation (EC) No 1049/2001. The new deadline expires on 13 June 2019.

Dear Mr Teffer,
 
I refer to your e-mail of 25 April 2019, registered on the same day, by
which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents (hereafter ‘Regulation (EC)
No 1049/2001’).
 
I also refer to our holding reply of 20 May 2019, by which the time limit
for replying to your confirmatory application was extended by 15 working
days, pursuant to Article 8(2) of Regulation (EC) No 1049/2001. In
addition, I would like to refer to our e-mail of 5 June 2019, by which we
informed you that the European Commission has identified additional
documents which would fall within the scope of your request, and which
require a careful assessment under the said Regulation.  
 
I regret to have to inform you that we will not be able to respond within
the extended time limit, which expires on 13 June 2019, as we have not yet
finalised internal consultations. However, I can assure you that we are
doing our utmost to conclude these consultations and provide you with a
final reply as soon as possible.
 
I regret this additional delay and sincerely apologise for any
inconvenience this may cause.

Dear Mrs Oliván Avilés,

Thanks for your e-mail dated 13 June 2019 and your apologies for the failure to handle my access to documents request within the legal deadline. I believe your sincerity in saying that you are doing your best to handle my request as soon as possible.

But let me point out a discrepancy here. When I myself miss a deadline, the Commission is inexorable.

You yourself signed a letter on 11 January 2019, rejecting to consider a confirmatory application related to Gestdem 2018/4619 purely for the reason that it “was lodged outside the applicable deadline defined in article 7(2) of regulation 1049/2001”.

The pure reason of having missed the deadline was a reason for the Commission was “not in a position to handle your application”.

I too regret the additional delay, and urge the Commission to act the same way it is expecting EU citizens to act, namely to respect deadlines.
