Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

-Correspondance between authorities the body works with to ensure consistent data protection.

-Incidences when it was found that a member state/body/government/company did not comply with regulations.

-Subsequent correspondance and enforcememnt of laws with the member state/body/government/company which was not in compliance.

As you know, we are currently assessing your access to documents request
registered on 9 November under ref. 2013-1236.

 

You requested "Incidences when it was found that a member
state/body/government/company did not comply with regulations" and
"Subsequent correspondence and enforcement of laws with the member
state/body/government/company which was not in compliance".

 

In this respect, we would like to clarify that the EDPS is not responsible
for assessing compliance with data protection regulations of Member
States, governments or companies. On the basis of its founding act,
Regulation (EC) No 45/2001, the EDPS supervises the application of the
data protection rules set out in that Regulation by EU institutions and
bodies, including the European Commission, the European Parliament and the
Council of Ministers.

 

The European Commission is responsible for the transposition and
application by Member States of the general data protection Directive
95/46/EC. In turn, enforcement of national data protection laws
(transposing Directive 95/46/EC) is the competence of independent national
Data Protection Authorities.

In its consultative role, the EDPS advises the EU institutions and bodies
(but not the Member States, DPAs or companies) on data protection issues
in a range of policy areas. We analyse proposals for new EU legislation
and EU soft law instruments that affect personal data protection in the
EU.

Finally the EDPS cooperates with national authorities in order to promote
consistency in the protection of personal data throughout the EU. The
central forum for cooperation is the Article 29 Working Party, where the
national data protection authorities meet to exchange views on current
issues, to discuss a common interpretation of data protection legislation
, to give expert advice and to promote the uniform application of the Data
Protection Directive.
