Comitology - C35200 - Committee concerning applicable law, jurisdiction and enforcement in matrimonial matters, parental responsibility and maintenance obligations

Justice et Consommateurs n'avait pas les informations demandées.

Dear Justice and Consumers,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Background:
When installing and monitoring the EU law the European Commission sets up commissions.
For the EU law EC2201/2003 - so called Brussels IIa - there is a Committee (got to know through a full text search in the yearly reports - see below):

"C35200 - Committee concerning applicable law, jurisdiction and enforcement in matrimonial matters, parental responsibility and maintenance obligations"

Further there are annual reports of all committees:
http://ec.europa.eu/transparency/regcomi...

When going through the reports there was nothing in the 2013, 2012 report.

In the 2011 report:
http://ec.europa.eu/transparency/regcomi...
I found one entry saying that there was an 'Advisory Examination' for one of all the two regulations: Regulation (EC) No 2201/2003 Regulation (EC) No 4/2009 this committee seems to deal with. Is said there was a meeting. No '..opinions', no 'written procedures', no '..implementing acts adopted' and no '..measures adopted according to RPS'

As EC2201/2003 was implemented around 10 years ago I would like to know:

(1) The names of the members who were in this committee (the initial ones and the changes with date left or coming in,
(2) their profession and
(3) nationality,
(4) if and whom of the EU commission members and the
(5) EU commissioners (I suppose for Justice) were party of this meetings.
(6) Further I would like to know when they came together in the past 10 years and who was joining
(7) if and when there were 'implementing acts adopted'
(8) if and when there were measures adopted

I have put already some document requests through:
http://ec.europa.eu/transparency/regcomi...

O037839/01 - SUMMARY REPORT V038188/01 (Voting sheet) D036884/01(Draftimplementingmeasure/act)O036882/01 (Other document) in dossier CMTD(2014)1510 V016636/01 (Voting sheet) in dossier CMTD(2011)0864 S016605/01 (Summary record) CMTD(2011)0269 O015822/01 (Other document) CMTD(2011)0864 O015821/01 (Other document) CMTD(2011)0864 D015820/02 (Draft implementing measure/act) CMTD(2011)0864 D015820/01 (Draft implementing measure/act) CMTD(2011)864 A013500/01 (Agenda) CMTD(2011)269

but I need to know all what happened to EC2201/2003 since it was created.

Yours faithfully,

Klaus Zinser

Dear Justice and Consumers,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Justice and Consumers's handling of my FOI request 'Comitology - C35200 - Committee concerning applicable law, jurisdiction and enforcement in matrimonial matters, parental responsibility and maintenance obligations'.

I had asked:
"C35200 - Committee concerning applicable law, jurisdiction and
enforcement in matrimonial matters, parental responsibility and
maintenance obligations"

As EC2201/2003 was implemented around 10 years ago I would like to
know:

(1) The names of the members who were in this committee (the
initial ones and the changes with date left or coming in,
(2) their profession and
(3) nationality,
(4) if and whom of the EU commission members and the
(5) EU commissioners (I suppose for Justice) were party of this
meetings.
(6) Further I would like to know when they came together in the
past 10 years and who was joining
(7) if and when there were 'implementing acts adopted'
(8) if and when there were measures adopted

In the documents received there were no names of information requested.

I cannot believe that there are no documents with thenames of this people. I am sure they are on the EU payroll.

Kindly review the position given 'there are no documents' and start to answer question number 1 and then 2 to 8.

A full history of my FOI request and all correspondence is available on the Internet at this address: http://www.asktheeu.org/en/request/comit...

Yours faithfully,

Klaus Zinser

Klaus Zinser a laissé une remarque ()

It is very strange that they establish a comittee 'C35200' but they say they don't have a document with the names of the members. In case they say I have not asked the right question they should still answer and it is otherwise misleading. Whats about accountability and transparency ?

Therefore a complaint at the ombudsman - who unfortunately never investigates when there is a request from 'Zinser' - has been launched.
