sg-acc-doc@ec.europa.eu,

Hello,

We are writing concerning your confirmatory request for access to
Commission documents for case 2022/4114, registered on 4 October 2022.

As you did not receive a reply to your initial request registered on 31
August 2022, you submitted a confirmatory request.

In the meantime, the initial reply in question was sent to you on 12
January 2023.

Against this background, the Secretariat-General has closed your
confirmatory request.

You can submit a new confirmatory request for this case in accordance with
Article 7 of Regulation (EC) No 1049/2001 if you wish to ask for a review
of the initial reply.

Kind regards,

SG.C1 Access to Documents Team

Dear Energy,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Communication and meetings with ENTSOG'.

As I have requested for all documentation about communication between DG ENERGY and ENTSOG - not more than one organization, as you can see, for a period no longer than a couple of months - I cannot help but wondering why it has taken the Commission from July 18 2022 up to January 12 2023 to respond to my request.

I would still very much like to hear an explanation concerning this unacceptable delay, because thoughts of deliberate stalling are still coming to mind..?

Dear Mr Wetzels,

Thank you very much for your email of 3 March 2023.

First, we would like to sincerely apologise, on behalf of the Directorate-General for Energy, for the delay in the handling of your initial application registered under the reference 2022/4114.

Secondly, we would like to invite you, in accordance with Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents, to provide a clarification as to the scope of your request.

More specifically, we invite you to confirm whether by your email, you intend to enquire solely about the reasons underlying the delay of the initial reply of the Directorate-General for Energy of 12 January 2023.

In the affirmative, please kindly note that, whereas the European Commission strives to handle all applications for access to documents as swiftly as possible, it is sometimes unable to do so due to inter alia the number of incoming requests in light of its limited human resources, but also other time-consuming factors such as the complexity of the requests pending at the same time, the number of documents requested therein, the required underlying internal and external consultations as well as the possible translations to be performed. In this instance, it should be moreover stressed that the subject of energy has received an increased interest since 2022 in light of the evolving international situation. Against this background, the Directorate-General for Energy had therefore to handle an increased number of requests for access to documents, whilst addressing pressing issues in order to fulfil, under the current complex circumstances, its mission to ensure access to affordable, secure, reliable and clean energy for all Europeans; to promote efficient production and use of energy; and to drive the process of becoming the first climate-neutral continent while contributing to Europe's sustainable growth and job creation.

Against this background, should you, however, confirm that your intention is to submit a request for a review as to the substance of the initial reply of the Directorate-General for Energy, your application will be registered as confirmatory application under Regulation (EC) No 1049/2001.

Should you need any further assistance in clarifying or specifying your application, you can contact us by sending an email to: [email address]

Thank you very much in advance for both your kind understanding and clarification.

Please note that in accordance with the Commission’s Detailed rules for the application of Regulation (EC) No 1049/2001, the registration and handling of your application are temporarily suspended pending the provision of the requested clarification.

Yours sincerely,
