Complaints when public access to EU documents has been denied despite the recommendations of the Ombudsman

La demande est réussie.

Dear European Ombudsman,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents, which contain the following information:

All complaints that adress cases where public access to EU documents has been denied despite the recommendations of the Ombudsman to provide public access to them, in the years 2010-2014. Furthermore, I request access to documents where the motivations for refusing access to the requested documents are stated. For example the desicions of the European Ombudsman when closing the inquiries into the complaints, as in the case 2293/2008/(BB)(FOR)TN (URL: http://www.ombudsman.europa.eu/cases/dec... ).

Thank you.

Yours faithfully,

Sanna Wännström

Dear Ms Wännström,

On 18 February 2016, you made the two requests contained in your message
here below.

With regard to the first request, I have understood it to refer to inquiry
cases in which the Ombudsman issued unsuccessful recommendations on public
access to documents.

The Ombudsman would normally close such inquiries with what we call a
'critical remark'. I therefore suspect that what you are looking for is
extractable from our website, and I will here below show you know how that
can be done. In addition to the public accessibility, carrying out the
extraction will entail the benefits of hyperlinks and full text searches.
Needless to say, we are also eager to increase the public's know-how for
carrying out independent searches on our website.

Here is the cases section and its search engine:
[2]http://www.ombudsman.europa.eu/cases/hom...

In it, the search that I would advise you to carry out is illustrated here
below. It should give you 17 (one seven) hits.

With regard to your request for "documents where the motivations for
refusing access to the requested documents are stated", I am afraid that
we do not hold case related data that specifically correspond to that
description, and hence we cannot identify such documents in any reliable
manner. If you wish to elaborate on the nature of, or interest behind,
your request, then we may be able to help you with your research. Please
do not hesitate to ask me to call you if that could be helpful.

Kind regards,

Peter Bonnor
