- A list of all meetings between DG CLIMA and Perenco, Enel, Endesa and Glencore Xstrata in the last two years (October 2012 - November 2014). This can include an individual from said company representing an industry trade association.

- Minutes of all identified meetings.

- correspondence between DG Clima and said companies on the topics of a) climate targets and policy tools to tackle them (particularly carbon markets) b) the UN negotiations (specifically UNFCCC and Rio+20) c) the 2030 Climate and Energy Package

Dear Ms. Sabido,

 

I refer to your email of 6 October 2014, in which you submit a request for
documents relating to contacts between DG CLIMA and Presence, Enel, Endesa
and Glencore Xstrata in the last two years concerning:

–        climate targets and policy tools to tackle them (particularly
carbon markets)

–         the UN negotiations (specifically UNFCCC and Rio+20)

–        the 2030 Climate and Energy Package

 

This is a very broadly formulated request. The description given in your
letter does not enable us to identify concrete documents which would
correspond to your request. Consequently, we are unable to handle your
request in its present form.

We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No
1049/2001 regarding public access to documents, to make a more targeted
request and provide us with more detailed information on the documents
which you seek to obtain, such as the subject /scope of the request (which
specific policy paper you are referring to), references, dates and more
specific periods during which the document would have been produced,
persons  and precise names of the companies  you are referring to and
provide us with any other relevant information which would enable us to
identify the documents falling under your request.

You will no doubt understand that such broad request cannot be handled in
accordance with the normal rules on access to documents. We would,
therefore, suggest that you narrow down the scope of your application in
order to enable the Commission services concerned to handle them without
creating disproportionate administrative burden.

The 15 working days' time limit for handling your application will start
running when we receive the requested clarification.

Dear Climate Action (CLIMA),

Firstly, I would like to see the list of all meetings with the stakeholders I originally named (Perenco, not Presence). I don't agree that the request is too broad (I listed specific topics as well as specific dossiers, within a two-year window).

But to assist in finding all correspondence, please narrow the request to the following headings:

- EU positions during UNFCCC negotiations (COP19, COP20 and COP21), specifically GHG targets and the policy instruments to achieve them (ETS, REDD, CCS, biofuels, etc.)

- the 2030 climate and energy package

And please ensure that information is sent as soon as it becomes available, rather than waiting for it all to be assembled.

We refer to your request of 3 October 2014 and 22 October in which you
make a request for access to documents exchanged between Perenco, Enel,
Endesa and Glencore Xstrata companies and DG CLIMA in relation to UNFCCC
negotiations (COP19, COP20 and COP21), specifically  on GHG targets and
the policy instruments to achieve them (ETS, REDD, CCS, biofuels, etc.)
and the 2030 climate and energy package for the period  from 1 October
2012 to 6 June 2014 registered under the above mentioned reference number.

 

Your application is currently being handled. We are carrying out a
detailed research in order to identify any relevant documents falling
under the scope of your request. With regard to the scope of your request,
our research has not been yet completed. Moreover, as your requests
concerns third-party documents, the Commission will then need to consult
them with a view assessing whether an exception of Art. 4 of the
Reg.1049/2001 would apply.

Consequently, we will not be in a position to complete the handling of
your application within the time limit of 15 working days, which expires
on 11 November 2014. 

 

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 2 December 2014.

 

We apologize for this delay and for any inconvenience this may cause.
