Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents (including notes of minutes, emails and other correspondence) relating to contacts between DG CLIMA and AngloAmerican, BHP Billton and/or Glencore Xstrata, concerning policy areas connected to climate, energy, emissions or resource policies, in the last 18 months (since April 2013).

I have contacted DG CLIMA with my postal address, and noted that whilst I have made many access to documents requests before, this is the first time I have been required to give my postal address.

Since procedural requirements are cited as the reason for this, I have also asked if either the legal basis or procedural requirements have recently changed.

I have consulted the EC's "ACCESS TO EUROPEAN COMMISSION DOCUMENTS: A CITIZEN'S GUIDE" (http://ec.europa.eu/transparency/citguid...) and note that it states only that when making a request, "One of these three elements [address, fax, email address) must be filled in to enable the document requested to be sent" (p.12 footnote [1]).

I refer to your email of 11 and 15 September 2014, in which you submit a
request for documents relating to contacts between DG CLIMA and
AngloAmerican, BHP Billton and/or Glencore Xstrata, concerning policy
areas connected to climate, energy, emissions or resource policies in the
last 18 months (since April 2013).

 

This is a very broadly formulated request. The description given in your
letter does not enable us to identify concrete documents which would
correspond to your request. Consequently, we are unable to handle your
request in its present form.

 

We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No
1049/2001 regarding public access to documents, to make a more targeted
request and provide us with more detailed information on the documents
which you seek to obtain, such as the subject /scope of the request (which
of the climate policies you are referring to), references, dates and more
specific periods during which the document would have been produced,
persons  and precise names of the companies  you are referring to and
provide us with any other relevant information which would enable us to
identify the documents falling under your request.

 

You will no doubt understand that such broad request cannot be handled in
accordance with the normal rules on access to documents. We would,
therefore, suggest that you narrow down the scope of your application in
order to enable the Commission services concerned to handle them without
creating disproportionate administrative burden.

 

The 15 working days' time limit for handling your application will start
running when we receive the requested clarification.

As I received the request for clarification directly to my email address, I sent a clarification directly to CLIMA on 16/09/14 stating:

"I hereby clarify and narrow the scope of my request to include only documents relating to contacts between staff of DG CLIMA and staff of Anglo American PLC, on the subjects of the EU2030 climate and energy package (including the EU-ETS) and/or European positions on climate and energy at international fora, since the 1st January 2014."

I then received a further request from CLIMA, also on 16/09/14, asking me to clarify which climate and energy fora you have in mind (i.e. dates and names of such events/meetings). I responded on the same day with the clarification that such fora should include:
"UNFCCC events (COP20 that took place in Warsaw November 2013, the UNFCCC intercessionals in Bonn 10 - 14 March, 4 - 15 June and 20-25 October 2014, plus the upcoming COP21 in Lima 1-12 December 2014), the Abu Dhabi Ascent 4-5 May 2014, the Ban Ki-Moon Climate Summit in New York 23 September 2014, the G7 summit in Brussels June 4-5 2014, the Brisbane G20 summit November 15-16 2014, the Carbon Expo in Cologne 28 - 30 May 2014, and the Africa Carbon Forum July 2-4 2014".

Dear Ms. Tansey,

 

We refer to your email of 11 September 2014 and 16 and 17 September 2014
in which you make a request for access to documents, registered under the
above mentioned reference number.

 

We regret to inform you that no documents were found that would correspond
to the description given in your application.

Indeed, as specified in Article 2(3) of Regulation 1049/2001, the right of
access as defined in that Regulation applies only to existing documents in
the possession of the institution.

 

Given that no such documents have been identified, the Commission is not
in a position to handle your request.
