I refer to your e-mail of 6 February 2013 by which you present a request for access to documents of the Legal Service. Your request reads as follows:

"Under the right of access to documents in the EU treaties, as
developed in Regulation 1049/2001, I am requesting documents,

or Legal Services staff and Mr. Michel Petite or other lawyers
working with Clifford Chance."

In this regard, I would like to underline that Clifford Chance is a global law firm employing hundreds of lawyers dealing with a high variety of subject matters.

Article 6(1) of Regulation 1049/2001 provides that "applications for access shall be made in a sufficiently precise manner to enable the institution to identify the document". Pursuant to paragraph 2 of Article 6, "if an application is not sufficiently precise, the institution shall ask the applicant to clarify the application and shall assist the applicant in doing so,…".

Since your application is formulated in very broad terms without any limitations as to the possible persons and matters concerned or the period covered, we kindly request you to clarify its scope in relation to these three points in order to enable the Commission to identify the document(s) which would be subject of your application.

Pending that clarification, the Legal Service is not in a position to deal with your request.

1) I request access to ALL documents (including notes of minutes, emails and other correspondence) dating from the period 1 January 2012 - 25 February 2013 AND relating to the (revision of) the Tobacco Products Directive AND relating to contacts between Legal Services staff and Mr. Michel Petite or other lawyers working with the Brussels, Paris or London offices of Clifford Chance.

2) I also request access to ALL documents, including notes of minutes, emails and other correspondence relating to contacts between Legal Services staff and Mr. Michel Petite over the period 1 January 2008 - 25 February 2013.

We refer to your message of 26 February 2013 below by which you clarified your request for access to documents presented on 6 February 2013.

Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 19/03/2013.

An extended time limit is needed as we are still busy identifying and analysing the documents concerned by your request.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 12/04/2013.
