Contracts/agreements with Member States

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

- all contracts, agreements and/or contractual statements signed with any of the 28 EU Member States in regards to Joint Operation Triton 2016;
- all contracts, agreements and/or contractual statements signed with any of the 28 EU Member States in regards to Joint Operation Triton 2017;

These documents may be related – but not limited – to the cession or contribution by Member States of assets to be deployed in the operation, or other kind of material or financial contributions from Member States to Frontex and viceversa in relation to Operation Triton.

Dear Ms Izuzquiza,

 

We have been informed by the responsible Unit that the search has
identified approximately 150 to 250 documents which would satisfy the
criteria indicated.  The number could still increase as the search is not
validated. These documents could amount to approximately 1,000 pages.

 

Proceeding with this request would constitute a significant administrative
burden for the Agency. Therefore, pursuant to Article 6(3) of the
Regulation (EC) No 1049/2001 of the European Parliament and of the Council
of 30 May 2001 regarding public access to European Parliament, Council and
Commission documents, we kindly invite you to reconsider the scope of your
request with a view to finding a fair solution.

 

Would you please consider narrowing down your request? For example by
limiting the scope to certain assets you are interested in or to certain
EU Member States? This would certainly assist us in providing you with the
documents you are especially looking for, while avoiding the processing on
our part of a very large number of documents. Please note that depending
on your answer, we might need to extend the initial deadline further.

Dear Frontex,

Thank you for your response. I understand your concerns and I would therefore like to limit the scope of my request as follows:
- only the contracts, agreements and/or contractual statements signed in regards to Joint Operation Triton 2016;

I would also like to prioritise those contracts, agreements and/or contractual statements signed with the following Member States: Spain, Sweden, Denmark and Finland.

The agreements signed with the rest of EU Member States could follow after this initial batch.

I hope you find this solution a suitable one. Please don't hesitate to let me know if there's any other clarification or specification you need from me.

Dear Ms. Izuzquiza,

As your request is still quite extensive and needs the revision of a considerable number of documents, we are extending the deadline by 15 working days pursuant to Article 7(3) of Regulation 1049/2001. This extension concerns both your requests concerning (1) the contracts, agreements and/or contractual statements signed in regards to Joint Operation Triton 2016 for Spain, Sweden, Denmark and Finland (reg. no. 27337) as well as (2) the request concerning the same contracts, agreements and/or contractual statements vis-à-vis Norway (reg. no. 27931).

Nevertheless, we will do our best to get back to you as soon as possible with all the documents requested.
