3. In case DG INFSO instructed the audit firm to conduct an external financial audit to the litigants, the correspondence with the audit firm (letters and emails), as well as notes to the file.

11. For audits conducted not in an EU Member State, the documents the Commission services drew up pursuant to article 22 of Regulation 45/2001.

12. The article 25 of Regulation 45/2001 prior notification(s) that covered at the material time the external financial audits that led to the litigation.

13. The documents DG INFSO drew up pursuant to article 12(1) of Regulation 45/2001 as regards the personal data of third parties, whose personal data DG INFSO obtained from the audit firms (found in the audit reports).

14. For each single audit, two sample time-sheets. The identification of the data subject is to be redacted, but hours worked in research projects to be disclosed.

15. The documents with which DG INFSO instructed or caused, as the case may be, the audit firms to process personal data of third parties to the audited projects.

In DG INFSO external financial audit reports, DG INFSO has stated that the audit followed the International Standards on Auditing.

Copies of the following documents are kindly requested:

16. The documents with the internal administrative decision(s), or equivalent, to adopt the International Standards on Auditing, or equivalent, for the conduct of the external financial audits of the Research DGs.

17. The documents assessing the professional capabilities of the external audit Unit of DG INFSO (O.2 and S.5 Units) to conduct audits in accordance to the International Standards on Auditing, or equivalent.

18. The documents assessing the professional capabilities of the R.4 'Compliance' DG CNECT Unit to conduct audits in accordance to the International Standards on Auditing, or equivalent.

19. The documents establishing that the signatories of the audit reports of the O.2 & S.5 Unit of DG INFSO, and the R.4 DG CNECT Unit are qualified Auditors (hence they are entitled to sign audit reports according to the standards), or equivalent.

The following paragraphs argue for the most extensive and lawful release of the requested documents.

DG CNECT may NOT refuse to disclose parts of the documents containing information lawfully in the public domain. This specifically includes information in the documents found at the website of the General Court.

DG CNECT has already released released letters notifying the conduct of an external financial audit, so it must do likewise in this application.

The templates of audit reports are public documents; they were part of the specifications of the call for tenders. Consequently, DG CNECT may not refuse disclosure of the audit reports, except the parts of the documents disclosing personal data of third parties to the audited projects.

In the disclosed documents, DG CNECT may NOT redact more than what is strictly necessary to comply with article 4(1)(b) of Regulation 1049/2001.

There may be a few parts of the documents protected by article 4(2) first indent (commercial interest) of Regulation 1049/2001. DG CNECT is to redact only what is strictly necessary to ensure compliance.

DG CNECT man NOT claim that article 4(2) third indent of Regulation 1049/2001 (purpose of audits) is applicable: First, the audits reports are more than two-years old. Second, release of the documents cannot influence the conduct and results of future audits. Third, having due regard to article 57(2) of the Financial Regulation 1605/2002, as amended, audits conducted by an audit firm are not audits within the meaning of this provision.

Finally, there is an overriding public interest to release the documents at issue to scrutinise:

1. The compliance of DG INFSO with legality
2. Full compliance with Regulation 45/2001
3. Whether the use of the International Standards on Auditing has been properly and lawfully adopted
4. That the DG INFSO and DG CNECT staff are professionally qualified to oversee and manage audits according to those standards

A kind reminder about the failure of DG CNECT to acknowledge the registration of the application was sent on 11 January

According to the asktheeu.org website DG CNECT has been silent, that is to say 20 working days after the submission of the application on 11 December there have been no developments. This is clearly totally unacceptable.

Although DG CNECT might find the application as somewhat awkward to handle - for it will cause the release of documents showing the disregard of legality by the external audit Units of the former DG INFSO, especially Regulation No 45/2001 - nevertheless this is not a legitimate reason to frustrate citizens rights enshrined in Regulation No 1049/2001. DG INFSO ought to have considered this possibility in 2007 when it decided to unleash the aggressive and intrusive campaign of external financial audits.

Whilst an administrative department may opt to unlawfully frustrate citizens rights of access to documents, under such circumstances these citizens may write to the Commissioner, Members of Civil Liberties Committee of the European Parliament and supervising authorities kindly drawing their attention to all this. Who knows, MEPs and supervising authorities may themselves submit applications under Regulation No 1049/2001 for the same documents.

In the light of the above, I expect that DG CNECT would promptly acknowledge the registration of the application.
