Contributions to the legislation "Directive 2012/29/EU" by non-governmental organizations

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

We seek access to documents containing information about which actors have contributed to the legislation "Directive 2012/29/EU establishing minimum standards on the rights, support and protection of victims of crime".

We would like the list to include:
- name of actors (organizations, NGOs, politcal foundations, individuals...) who have worked in on and contributed to the legislation
-form of contribution
-form of contact with MEPs (meetings)

have contributed to the Directive 2012/29/EU establishing minimum
standards on the rights, support and protection of victims of crime".

 

The several steps of the legislative procedure 2011/0129(COD) that lead to
the adoption of Directive 2012/29/EU, from the Commission proposal to the
adoption of the directive, jointly by the European Parliament and the
Council of the European Union, are set out on the Parliament webpage under

This webpage also gives an extensive overview of the institutional
contributors (The European Parliament committee involved, the EP

with interested parties, as detailed by point 2) of the Explanatory
Memorandum of the directive proposal:

The Commission proposal was submitted to the European Parliament and the
Council of the European Union for it to be assessed and processed
following the ordinary legislative procedure. For more information on the

As far as contributions from organizations, NGOs, politcal foundations,
individuals, etc are concerned, the European Parliament and the Commission
jointly manage a Transparency Register, with which interest
representatives (lobbyists) may register. Many of the registered interest
representatives stated the matters they are interested in. Those who have
stated an interest in protecting crime victims (and who might have
published position papers or lobbied Members of the European Parliament on
the legislative procedure 2011/0129(COD)) can found under this link:

However, the Register does not provide for the mandatory registration of
all interests representatives and natural persons who may contact Members
of the Parliament. Interest representatives and natural persons are not
required to register all their contacts with MEPs either.  Neither are
they required to state the nature of the contact (whether they have met in
person, discussed a specific topic, sent a letter, participate in a
conference, etc). 

 

Documents from interest representatives, like position papers, may have
been sent to Members of the Parliament. However, in principle, Member’s
documents are not Parliament documents, and Parliament would not be in a
position to access such documents and much less to identify and disclose
them.

 

There is indeed an organic separation between the public mandataries and
the European Parliament itself. According to Rule 116(2) of the Rules of
Procedures, for the purpose of access to documents, the term 'Parliament
documents' means any content within the meaning of Article 3(a) of
Regulation (EC) No 1049/2001 which has been drawn up or received by
officers of Parliament within the meaning of Title I, Chapter 2, of these
Rules, by Parliament's governing bodies, committees or antiparliamentary
delegations, or by Parliament's Secretariat. In accordance with Article 4
of the Statute for Members of the European Parliament, documents drawn up
or received by the elected representatives or political groups are
Parliament documents for the purposes of access to documents only if they
are tabled in accordance with the Rules of Procedure.

 

Nevertheless, interactions between interest representatives and the
European Parliament are recorded in the event they take place within the
framework of the institution's parliamentary work. In this respect, a
search on the EP Public Register of documents shows that the persons that
have attended official meetings of the European Parliament concerning or
touching upon the legislative procedure concerning standards on the
rights, support and protection of victims of crime.
