Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

In document number 9900/14, a summary of the 2497th meeting held in Brussels on 14, 15 and 19 May 2014, at point 40 there is a short summary of the discussion held in the Council on the basis of document number 8622/1/14 REV 1. I am writing to request all documents linked to this discussion, particularly those which indicate which Member States preferred which of the three options presented to them. This includes email correspondence.

Dear Mr. Jakob Thomson,

I am writing to file a confirmatory application in response to your answer, dated 24 June 2014 with reference number Ref. 14/1033-jt/ls/mi/jj, in which you provide only partial access to document number 8622/1/14 REV 1.

In your response, you provide information about the content of the document that is being redacted and cite Article 4(3) of Regulation 1049/2001, which serves to protect the decision-making process, in order to deny access to parts of the document.

However, you fail to outline specifically how and why disclosure of those parts of the document could seriously, forseeably and more than purely hypothetically undermine the Council’s decision-making process.

In addition, as is clear from the judgement of the General Court on 22 March 2011 in the case of Access Info Europe v Council, the mere fact that the Council has still not taken a position on the issue, is not sufficient to conclude that the release of that information would cause any harm to the decision-making process (paragraph 76 of the judgment in case T-233/09).

Furthermore, in your response you have failed to take into account the public interest in this information, which relates to the manner in which the Council will apply the ruling of the European Court of Justice by which Member State positions should be made available to the public as a matter of course, unless they are specifically covered by Article 4 of Regulation 1049/2001. The manner in which transparency rulings are applied by the Council is of great public interest, particularly for citizens and civil society organisations such as Access Info Europe who are intent on monitoring the extent to which their fundamental right of access to EU documents is respected by the various EU institutions.

In our analysis, the fact that the decision has not yet been taken in fact serves to increase the public interest in obtaining that information in a timely manner, in order to permit public participation in and scrutiny of the Council's decision-making process. This serves to increase the legitimacy of the EU institutions in the eyes of the public and is in line with the requirements of the Treaty of Lisbon to have an open decision-making process.

For these reasons I respectfully urge you to reconsider your decision of 24 June 2014 so as to provide me with full access to document number 8622/1/14 REV 1.
