Dear Sir,

We refer to your e-mail dated 23/05/2013 in which you make a request for
access to documents, registered on 24/05/2013 under the above mentioned
reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 14/06/2013.

An extended time limit is needed because, in order to retrieve the
documents requested, large files have to be examined.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 5/07/2013.

the above mentioned reference numbers.

For the purposes of processing your requests efficiently, we would kindly
ask you to clarify the following points.

We have noted that your two applications are drafted in very similar terms
and, consequently their scopes are overlapping to a very large extent. We
would therefore appreciate if you could let us know firstly, whether your
application registered under the reference Gestdem 2013/2352 is intended
to replace your previous application registered under the reference
Gestdem 2013/2798.

In the negative, we would like to propose to handle both applications
jointly. (Both will be processed under the reference number of your last
application, namely Gestdem 2013/2352).

Moreover, the description given in your applications does not enable us to
identify concrete documents which would correspond to your request(s). We
therefore invite you, pursuant to Article 6(2) of Regulation (EC) No
1049/2001 regarding public access to documents, to provide us with more
detailed information on the documents which you seek to obtain,

As there is indeed no public-private partnership "in life sciences
research and innovation" per se, we would be grateful if you could
clarify, secondly, in which joint-technology initiative you are
interested.  More specifically, you should indicate whether you are
referring to the Innovative Medicine Initiative (namely, IMI1 or 2), or to
Joint Technology Initiative in the field of Bio-based industries (BBI).

The time limit for handling your applications will be suspended until we
receive the requested clarifications.

Thanks for your email.

The applications are different. In the first one, dated 2nd of May, with GestDem 2013/2352 I asked for

- a list of meetings of DG Research and Innovation officials and/or representatives (including the Commissioner and the Cabinet) and representatives of EuropaBio between January 2012 and today.

- minutes and other reports of these meetings;

- all correspondence (including emails) between the Commissioner and the Cabinet and DG Research and Innovation related to public-private partnership in life sciences research and innovation under Horizon 2020 between January 2012 and today.

In the second one, dated 23rd May, registered under the reference Gestdem 2013/2798 I asked for further information on the same topic, but refering to external correspondance with EuropaBio

- All correspondence (including emails) between DG Research and Innovation officials and/or representatives (including the Commissioner and the Cabinet) and representatives of EuropaBio related to public-private partnership in life sciences research and innovation under Horizon 2020 between January 2012 and today.

Please handle them separatetly as I have been already waiting for the first one for more than two months. And we are already beyond the extended deadline.

Regarding your second clarification request, please include the information on the Joint Technology Initiative in the field of Bio-based industries (BBI).

We would like to sincerely apologise for the prolonged delay in handling
your application for access to documents registered under the reference
number Gestdem 2013/2352 which is due to the fact that the description
given in your application did not enable us to identify concrete documents
corresponding to your request. 

We have now noted your clarifications and will process both applications
for access to documents accordingly. Please be assured that we will handle
them both with the utmost care and as promptly as possible.

However, we note that both your applications concern a very large number
of documents, which need to be assessed individually. Such a detailed
analysis cannot be carried out within the normal time limits set out in
Article 7 of Regulation 1049/2001.

The Regulation provides for a possibility to confer with applicants in
order to find a fair solution when an application concerns a very large
number of documents. Article 6(3) provides that "in the event of an
application relating to a very long document or to very large number of
documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution".

Based on this provision, we would kindly ask you whether you could narrow
down the scopes of your requests, so as to reduce them to a more
manageable amount of documents. If that is not possible and if you
maintain your request for access to all documents concerned by your
applications, we propose to handle both applications by 30 August 2013.

We sincerely regret not to be able to handle your applications earlier but
we have received recently a large number of applications for access to
documents from the asktheEU website with unusually wide scope and your two
requests alone require very  labour-intensive and time-consuming searches
as they do not relate to specific documents as such.
