Correspondence members Euradopt with European Commissioners

La demande est partiellement réussie.

Dear Enlargement (ELARG),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The below extract of the minutes of the October 2007 meeting of Euradopt contain a call for action towards the European Commission.

" - Jennifer Degeling from the Permanent Bureau in the Hague and representatives of four Central Authorities had a meeting with the NAC delegates. All parties agreed that we need a concerted effort to try and influence the ideas within the European Union, where it has been argued that inter-country adoption is not a child protection measure and is a last resort. I regard our discussion as a step forward in the EU issue.

.../...

European Union

The Italian commissioner for Freedom, Security and Justice, Mr Frattini, has issued a tender for a study about adoption legislation in Europe. The time limit was Sept 21. When a tenderer is known, EurAdopt will contact him/her/them and offer our co-operation. The purpose of the study is i.a. to identify possible solutions to difficulties which prevent European citizens from exercising parental responsibility, and to study the possibility of setting up a Euroean adoption procedure between members states. Thankyou AiBi [Sic: Amici dei Bambini] for informing the Executive Board!

It is of continued importance that the EurAdopt members contact their respective commissioner and members of European Parliament about the informal and negative attitude to intercountry adoption which has been expressed within EU. If you need renewed material or more arguments, you can email me."

I would like to have access to any letters received from members of Euradopt by the respective Commissioners and/or Commissioner Olli Rehn, Franco Frattini, Jacques Barrot and President Barroso. Including responses given, related internal notes and phone logs.

Period 2005 - 2009.

Your application is currently being handled.

As you know, part of the request will be handled by the departments in the
Secretariat General of the Commission. However, DG JUSTICE has been
charged to deal with almost all the requested correspondence.

You are asking for documents which were falling into the competence of 12
different Commissioners in the former Commission mandate. All documents of
former Cabinets are currently in the historical archive.

Researches and retrieval of documents in the historical archives require
more time and many of them will furthermore require consultation with
third parties. In this context, we will not be in the position to complete
the handling of your application within the assigned time limit, which is
19 June 2014.

We have therefore to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents.

The new time limit expires on 10/7/2014. Our department will do all the
necessary to provide you with a final reply within the new deadline, but
we may come back to you should the consultation process take more time
than foreseen.

We apologize for this delay and for any inconvenience this may cause.

Best regards,

documents covered by your request.

Concerning your request to have all the replies and documents for which

does not allow for the upload of the documents.

(Please see copy of the "non-deliverable" message we received when we
tried to upload the second series of document in September. We decided on
that occasion to send them to your personal e-mail as we could grant full

provided access (full or partial) in August and September 2014, without
prejudice to the rules concerning the deadlines for a confirmative
