Dear Mr Viola, dear Secretariat-General,

Thank you for the response CONNECT/I2/VD/hz (2017)3495620 to my access to document request GestDem 2017/2215.

I am hereby filing a confirmatory application, requesting:

1. a verification if all correspondence by IFPI and GESAC was indeed included in the list of documents (1-10),
2. full access to documents 1, 4 and 5,
3. full access to documents 2, 6, 7 and 9.

We agree to the redactions for the protection of privacy according to (Art. 4 (1) (b)) of Regulation 1049/2001. However, we question whether the exception for the protection of legal advice would apply in this case as the communications were sent during the drafting and inter-service consultation period of the EU Commission. There is an overwhelming public interest in establishing whether these lobby groups had access to the confidential draft legislation that was not available to other stakeholders. According to Article 41.1 of the Charter of Fundamental Rights of the EU, every citizen has the right to an impartial handling of his or her affairs by the European institutions.

Yours sincerely,
Kirsten Fiedler
