Dear Mr. Panichi,

Following your request regarding public access to documents, you mentioned in your email dated 14th October 2015 that you are interested in:

"All correspondence between the Committee of the Regions and OLAF and/or COCOBO (CONT) committee relating to the case of Financial Controller/Internal Auditor of CoR, Robert McCoy.

The minutes of all CoR bureau meetings between August and December, 2004.

From 2003-2004, all correspondence between then Secretary Generals Vincenzo Falcone and Gerhard Stahl on the one hand, and members of the CONT committee (COCOBU) and/or OLAF on the other, relating to the case of CoR financial controller/internal auditor Robert McCoy, who had claimed harassment by the CoR".

Please, be informed that the Bureau documents are directly accessible on the website of the Committee of the Regions (http://cor.europa.eu/Pages/welcome.html).
However, the other documents have been submitted to the Court within the framework of a written procedure. Therefore, we consider that we cannot disclose the correspondence relating to the court proceedings, in particular when legal actions are still possible. This is to say that these documents cannot be accessed, under the exceptions of Article 4(2) second indent of Regulation 1049/2001.
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a confirmatory application requesting the Committee of the Regions to review this position.
Such a confirmatory application should be addressed within 15 working days upon receipt of this letter to the Secretary General of the Committee of the Regions at the following address:
